L Before the Board of Supervisors County of San Joaquin, State of California R- RESOLUTION APPROVING MAJOR SUBDIVISION APPLICATION NO. PA-0500838 OF JOE J. AND LILLIAN E. MACHADO. WHEREAS, on October 19, 2006 the San Joaquin County Planning Commission considered Major Subdivision Application No. PA-0500838; and WHEREAS, on 2005, this Board of Supervisors did conduct a public hearing on Major Subdivision Application No. PA-0500838 and notices of which hearings were ` given in accordance with law, and oral and documentary evidence having been received in favor of or opposed to said matter, and this Board of Supervisors being advised on the premises; and WHEREAS, this Board of Supervisors found that an Environmental Checklist("Checklist') contained in the Machado Project staff report was prepared for the project . The Checklist concluded that: 1)the project is a subsequent activity that is within the scope of the Specific Plan III EIR(SPIIIEIR); 2)there are no effects of the project that were not examined in the SPIIIEIR; 3)and no new mitigation is required for the project. Consequently, as provided by CEQA Guidelines Section 15168 (c), no new environmental document is required WHEREAS, this Board of Supervisors has determined that Major Subdivision Application No. PA-0500838 does not adversely affect the Mountain House Public Financing Plan, and meets all applicable provisions of the Development Agreement, based on the Findings for Major Subdivision Application No. PA-0500838 contained in the Machado Project staff report; NOW,THEREFORE, BE IT RESOLVED by this Board of Supervisors that Major Subdivision Application No. PA-0500838 is hereby approved, with the findings and conditions of approval attached hereto as Exhibit"A"and Exhibit"B" respectively and made a part of this Resolution. This Resolution shall become effective thirty (30) days after its adoption. r r
