III. COUNTY COUNSEL <br /> 1. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, <br /> and employees from any claim, action, or proceeding against the local agency or its agents, <br /> officers, or employees to attack, set aside, void, or annul an approval of the local agency, <br /> advisory agency, appeal board, or legislative body concerning a subdivision, which action is <br /> brought within the time provided for in Section 66499.37 of the Government Code. <br /> IV. PUBLIC WORKS (Staff Contact Michael Callahan,468-3000) <br /> 1. All easements of record shall be shown on the Final Map (Development Title Section 9- <br /> 910.20). <br /> V. SAN JOAQUIN COUNCIL OF GOVERNMENTS (Staff Contact Erin Sickler, 209- <br /> 468-3913) <br /> 1. In order to participate in the San Joaquin Multi-Species Habitat Conservation and Open <br /> Space Plan(SJMSCP), the developer shall complete the following steps to satisfy SJMSCP <br /> requirements: <br /> a) Contact the San Joaquin Council of Governments (SJCOG)to schedule a SJMSCP <br /> Biologist to perform a pre-construction survey prior to any ground disturbance. <br /> b) Sign and return to SJMSCP staff of SJCOG the Incidental Take Minimization Measures <br /> (given to the developer by SJMSCP staff after the pre-construction has been completed). <br /> c) Pay to SJCOG the SJMSCP fee based on SJMSCP findings. <br /> d) Upon paying the SJMSCP fee, receive from SJMSCP staff the Certificate of Payment. <br /> VI. AIR POLLUTION CONTROL DISTRICT (Staff Contact Jessica Willis, 559- <br /> 230-5818) <br /> 1. An Indirect Source Review application shall be submitted prior to or concurrent with the final <br /> discretionary application with San Joaquin County. <br /> 39 <br />
