MHCSD, solely controlled by the Board of Supervisors in its capacity as the legislative body of <br /> County. <br /> 1.1.10. Developer. THE JOE J. AND LILLIAN E. MACHADO FAMILY <br /> TRUST, dated March 17, 1993, and restated May 17, 1993 ("Machado"), and any successor in <br /> interest thereto in compliance with the provisions of Section 1.6. of this Agreement, including <br /> any Recognized Assignee thereof as to that portion of the Property transferred or assigned to <br /> such Recognized Assignee. Whenever the term "Developer" is used herein, it shall refer, <br /> severally, to: (a) each Party initially executing this Agreement as Developer as to the Property _ <br /> and as to those obligations of such Parties which continue hereunder following a Permitted <br /> Assignment; (b) following a Permitted Assignment, the Person or Persons then holding the legal <br /> or equitable title in the Property or portion thereof transferred pursuant to the Permitted _ <br /> Assignment as to the Property or portion thereof or interest therein transferred and as to the <br /> rights and obligations under this Agreement which are assigned and assumed with respect to <br /> such Property or portion thereof pursuant to a Permitted Assignment; and(c) any successor in _ <br /> interest to Developer or to a Recognized Assignee in compliance with the provisions of Section <br /> 1.6. of this Agreement as to the interest of such Person or Persons. <br /> 1.1.11. Development Agreement Legislation. California Government Code <br /> Sections 65864-65869.5,authorizing County to enter into Development Agreements, including <br /> subsequent amendments thereto. _ <br /> 1.1.12. Development Agreement Re¢lrlations. Division 13 of Title 9 of the <br /> Ordinance Code of San Joaquin County, establishing the procedures and requirements for the _ <br /> consideration and implementation of development agreements pursuant to the Development <br /> Agreement Legislation, including subsequent amendments thereto. <br /> 1.1.13. Development Documents. All documents necessary for the development <br /> of the Property, including but not limited to, the General Plan and amendments thereto, master <br /> plans and amendments thereto, ordinances, regulations, specific plans, special use permits, <br /> EIR/FEIR, negative declarations, variances, tentative maps and final map. <br /> 1.1.14. Development Permit(s). Development Permit means any discretionary or <br /> ministerial permit required for a project, excluding General Plans, Master Plans, Specific Plans, <br /> Special Purpose Plans, or amendments thereto, ordinance text changes, and rezonings. <br /> 1.1.15. Development Title. Title 9 of the Ordinance Code of San Joaquin County, <br /> as amended on November 10,1994,by Ordinance No. 3813 of the Board of Supervisors, as it <br /> may have been or may be subsequently amended from time to time and applied to the <br /> Community consistent with the Existing Approvals and the terms of this Agreement. <br /> 1.1.16.
