6. <br /> 6. <br /> to the Property consistent with the Existing Approvals and the terms of this Agreement, <br /> including conditions of approval(s). <br /> L <br /> 1.1.32. Morteaee. A mortgage, deed of trust, or similar security instrument or <br /> transaction in which the Property, or a portion thereof or an interest therein, is pledged as <br /> security, contracted for in good faith and for fair value in connection with the acquisition, <br /> development and use of the Property. <br /> 6. 1.1.33. MortQaeee. The holder of the beneficial interest under a Mortgage, or the <br /> owner of the Property, or interest therein, under a Mortgage. <br /> `, 1.1.34. Ordinances. The ordinances,resolutions, codes, rules, regulations and <br /> official policies of County, governing the permitted uses of land, density, design, improvement <br /> L and construction standards and specifications applicable to the development and use of the <br /> Property. Specifically,but without limiting the generality of the foregoing, Ordinances shall <br /> include the County's General Plan, Master Plan, Public Financing Plan, Specific Plan III,the <br /> Development Title, and the County's Building and Fire Codes. <br /> L <br /> 1.1.35. Other Governmental Entities. Any and all Federal, State, regional,and <br /> local governmental agencies and officials, other than County, having jurisdiction over the <br /> L Property or any aspect or part thereof. <br /> 1.1.36. Other Jurisdiction. Jurisdictions outside of the Mountain House <br /> L Community boundaries where the Developer is required to participate in roadway mitigation as <br /> defined in Table 3 of the Mountain House Transportation Improvement Fee Technical Report, <br /> L including Tracy, Contra Costa County and Alameda County. <br /> 1.1.37. Parties. County and Developer, and any subsequent Recognized Assignee <br /> as to its interest in the Property or portion thereof. <br /> L 1.1.38. Party. Either County or Developer, or any Recognized Assignee as to its <br /> L interest in the Property or portion thereof. <br /> 1.1.39. Permitted Assignment. A sale, assignment or transfer consented to by <br /> County pursuant to, or satisfying the other applicable requirements of, the provisions of Section <br /> 1.6.2. or 1.6.3. hereof. <br /> 1.1.40. Person (s). Any person, firm, association, organization,partnership, trust, <br /> ` corporation or company or combination of the foregoing. <br /> 1.1.41. Planning Commission. The Planning Commission of County, or any <br /> successor thereto. <br /> V <br /> 1.1.42. Pro e .
