%W AGREEMENT <br /> ` NOW, THEREFORE,pursuant to the authority contained in the Development Agreement <br /> Legislation, and in consideration of the mutual covenants and promises of the parties herein <br /> contained, County and Developer agree as follows: <br /> SECTION 1. GENERAL PROVISIONS. <br /> %W I.I. Definitions. In addition to other terms defined elsewhere in the <br /> `. Existing Approvals and this Agreement, the following definitions apply: <br /> `. <br /> 1.1.1. Agreement. This Development Agreement. <br /> %W 1.1.2. Approval(s).Any and all permits or approvals required under the Existing <br /> `, Approvals,this Agreement,the Ordinances or from Other Governmental Entities in order to <br /> develop the Property,including Development Permits. <br /> 1.1.3.Board of Supervisors. The governing legislative body of the County. <br /> 1.1.4. CEOA. The California Environmental Quality Act (Section 21000 et seq. of <br /> the Public Resources Code), including State and local regulations adopted pursuant thereto. <br /> `. 1.1.5. Community. The Mountain House Community, as defined in Recital F <br /> hereof and as shown generally on the map attached hereto as Exhibit A-3. The Mountain House <br /> Community consists of approximately four thousand seven hundred eighty-four(4,784) acres <br /> %W located at the southwestern edge of the County and northwest of the City of Tracy, as well as any <br /> off-site lands required by the MHCSD or the County to fulfill the requirements of the Master <br /> %W Plan. The Mountain House Community includes the Property and property owned by other <br /> %W property owners. <br /> %" 1.1.6. Community Developers. Any Person, as defined in Section 1.1.39, <br /> `, including,but not limited to, any Developer and/or Recognized Assignee, owning legal or <br /> ` equitable title to any Property in the Community, and proposing to develop or build on any <br /> Property in the Community. <br /> `- 1.1.7. Community Development Director. The Community Development Director <br /> of County or any authorized designee thereof or successor thereto. <br /> 1.1.8 Contractor(s). All persons, firms or corporations contracting with the <br /> V Developer to perform work or services on the Property, or in relation to development of the <br /> %W Property, including inspectors, subcontractors, design professionals and material suppliers. <br /> V 1.1.9. County.
