Mitigation Measure 4.9-4 in the SPHIEIR states that a developer of any Specific Plan III area that includes a school shall prepare a Preliminary Environmental Assessment(PEA) for the school for review by the California Department of Education(CDE), the California Department of Toxic Substances Control,the San Joaquin County Community Development Department,and the Lammersville School District. If the reviewing agencies determine that the school site does not meet CDE siting requirements, the school shall be built at a different location subject to a new PEA funded by the developer. Implementation of this mitigation measure would reduce impacts associated with locating a school in an area of potential hazards to a less-than- significant level. Mitigation Measure 4.9-5 in the SPUMIR addresses exposure to hazards associated with the PG&E-Chevron pipeline easement located southwest of the Machado property. It states that no residences shall be permitted within 68 feet of the edge of the easement.The nearest residence in the proposed project is approximately 2,300 feet away from the pipeline easement. Mitigation Measure 4.9-5 does not address the former Shell oil pipelines that cross the project site; these pipelines are discussed in Item b)below. DISCUSSION REGARDING PROPOSED PROJECT -- a) Create a significant hazard to the public or the environment through the routine _ transport, use, or disposal of hazardous materials? During construction of the proposed project,hazardous materials would be transported through the project area. Construction activities typically involve the use of potentially toxic substances such as paints,fuels,and solvents. People living in neighborhoods near the proposed project could be exposed to these materials as trucks move through their neighborhoods during construction at the project site. Construction activities would be subject to federal, state, and local laws and requirements designed to minimize and avoid the potential health and safety risks associated with hazardous materials. Furthermore, Mitigation Measure 4.9-1 in SPIIIEIR adequately mitigates these potential impacts. Commercial and limited industrial businesses would be established as part of the proposed project on the east side of the project site adjacent to Mountain House Parkway. These businesses could use hazardous materials that would be transported, stored and used on the site. Each business would have specific permit and reporting requirements under various federal, state,and local regulations associated with the proper transport,use,storage, and disposal of hazardous materials and wastes. Given these controls,impacts related to the transport, use, or storage of hazardous materials would be less than significant. Mitigation Measures No mitigation measures are required. 4-36
