B. In the event that any of the special determinations required herein cannot be made <br /> and are not waived, approval may nevertheless be given if all of the following conditions can be <br /> satisfied with respect to each such special determination not made: <br /> 1. Practicable and feasible requirements or mitigation measures can be <br /> imposed with respect to the undertaking of the proposed development of the Property, the <br /> implementation of which would allow such special determination to be made; <br /> 2. The Developer has consented to conditions of approval to include such <br /> mitigation measures and has agreed, if required by such conditions,to be bound by(through <br /> written agreement satisfactory to the County Counsel) and to implement such requirements or <br /> mitigation measures, and has agreed to post such security for compliance therewith as may be <br /> required by the Community Development Director; and <br /> 3.
