CONDITIONS OF APPROVAL <br /> MS-98-12 <br /> King & Lyons <br /> Minor Subdivision Application No. MS-98-12 was approved by the San Joaquin County <br /> Community Development Department on May 29, 1998. The effective date of approval is June 8, <br /> 1998. This tentative map approval will expire on June 7, 2001, which is three years from the <br /> effective date of approval, unless (1) all Conditions of Approval have been complied with and (2) <br /> a Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be <br /> fulfilled prior to approval of the Parcel Map. Those Conditions followed by a Section Number <br /> have been identified as Ordinance requirements pertinent to this application. Ordinance <br /> requirements cannot be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Chandler Martin, 468-3144) <br /> a. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) Lots 1 through 4 shall have a minimum lot width of 100 feet (Development Title <br /> Section 9-510.4). Lots 5 through 10 shall have a minimum lot width of 50 feet <br /> (Development Title Section 9-410.4). <br /> (2) Lots 1 through 4 shall have a minimum lot area of 10,000 square feet. (Development <br /> Title Section 9-510.3) <br /> (3) Lot 8 shall have sufficient frontage to meet Public Works access requirements. <br /> b. TRI-STATE MOTOR TRANSPORT FACILITY: The Existing Tri-State Motor Transport <br /> facility, including the extensive berming, shall be removed from this site prior to the <br /> approval of the Parcel Map. (Development Agreement No. DA-90-1, as amended) <br /> C. PRE-CONSTRUCTION SURVEYS: During the pre-construction period, project <br /> boundaries shall be staked; protective fencing shall be provided for vulnerable on-site <br /> habitats such as riparian corridors and nests/burrows; and pre-construction surveys shall <br /> be initiated 30-days before planned construction and shall be conducted prior to each <br /> project stage to locate burrowing owls, kit foxes, and kit fox dens. <br /> Any kit fox dens or burrowing owl nests identified within the path of construction shall be <br /> excavated prior to the breeding/nesting season under the direct supervision of a wildlife <br /> biologist, subject to the Department of Fish and Game and U. S. Fish and Wildlife <br /> Service approval. (Development Agreement No. DA-90-1, as amended) <br /> d. DEVELOPMENT AGREEMENT NO. DA-90-1/SPECIAL PURPOSE PLAN NO. PP-94- <br /> 1: The following note shall be placed on the Parcel Map: <br /> (1) Development of this site is subject to the Patterson Pass Business Park Special <br /> Purpose Plan (PP-94-1) and to Development Agreement No. DA-90-1, as <br /> amended.
