Polk Tr. <br /> 10549 North Jack Tone Road ENVIRONMENTAL HEALTH <br /> Stockton, CA 95212 PERMIT/SERVICES <br /> Conditional Certificate of Compliance <br /> Application Number PA-0900124 <br /> Pursuant to the provisions of the California State Subdivision Map Act and San Joaquin County Local Ordinances enacted <br /> pursuant to that Act, certification is hereby given that the following described property in the County of San Joaquin, State of <br /> California, remainder parcel shown as"Not a Part of this Subdivision", as shown on the Parcel Map filed in Parcel <br /> Map Book Page , has been granted a Conditional Certificate of Compliance.. To be created or <br /> recognized as a subdivided parcel for sale, lease or finance the following conditions must be satisfied before the property is <br /> in compliance with the aforementioned Ordinances and/or State Govemment Code: <br /> 1) Community Development Department <br /> a) A Certificate of Compliance is required for the remainder parcel shown as "Not a Part of this <br /> Subdivision". The property descriptions submitted with the Certificate of Compliance application shall <br /> substantially conform with the approved Revised Tentative Map dated February 28, 2013. A fee is required to <br /> process the Certificate of Compliance application. <br /> b) Right to Farm - The following note shall be recorded as a separate instrument with the Certificate of <br /> Compliance: <br /> (1) All persons purchasing parcels within the boundaries of this approved map should be prepared to accept <br /> the inconveniences or discomforts associated with agricultural operations or activities, such as noise, <br /> odors, insects, dust or fumes. San Joaquin County has determined that such inconveniencies or <br /> discomforts shall not be considered to be a nuisance. <br /> c) A"Notice of Minor Subdivision Restriction"shall be recorded concurrently with the filing of the Certificate of <br /> Compliance,with a reference to the instrument number of said recorded notice,stating that: <br /> (1) Neither the "Remainder Parcel' or "Parcel One" may be voluntarily transferred separately from the <br /> other parcel; however, if an institutional lender forecloses on either parcel, either parcel may be <br /> transferred separately in accordance with the power of sale provisions contained in the deed of trust. <br /> (2) Upon repayment of the loan,the owner of the "Remainder Parcel"shall merge the parcel with "Parcel <br /> One", as provided for in the Development Title, unless the owner of the homesite parcel acquired the <br /> homesite parcel through a foreclosure action, or unless the owner refinances the loan. <br /> (3) The"Remainder Parcel'shall remain a non-buildable site for primary dwelling units. <br />
