CONDITIONS OF APPROVAL <br /> PA-1300221 <br /> James A. Lagorio, INC. <br /> Minor Subdivision Application No. PA-1300221 was approved by the San Joaquin County Community <br /> Development Department on Aprill 11, 2014. The effective date of approval is April 21, 2014. This <br /> tentative map approval will expire on April 20, 2017, which is three years from the effective date of <br /> approval, unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map has <br /> been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Rick Griffin, [209]468-3154) <br /> a. TENTATIVE MAP: The Parcel Map shall substantially conform with the revised tentative map dated <br /> March 6, 2014. <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note shall <br /> be placed on the Parcel Map and recorded as a Notice of Minor Subdivision Restriction: <br /> All persons purchasing parcels within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities, <br /> such as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniencies or discomforts shall not be considered to be a nuisance. <br /> c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) Parcel 1 shall have a minimum lot width of 150 feet, measured at the front yard setback line. <br /> (Development Title Section 9-610.4) <br /> (2) Parcel 1 shall be between two (2) gross acres and five (5) gross acres in size. <br /> (Development Title Section 9-610.3[a]) <br /> d. NOISE: If noise sensitive development is proposed within 100 feet from the middle of Jack Tone <br /> Road along the Designated Remainder, then a noise study shall be required prior to noise sensitive <br /> development and construction must comply with recommended mitigation measures to achieve <br /> compliance with the standards specified in Table 9-1025.9. (General Plan Table III.D-4B, Volume III, <br /> page III.D-23) (Development Title Section 9-1025.9[a][11) (Development Title Section 9-1025.9(d)[4]) <br /> e. NOTICE OF NON-RENEWAL: A Notice of Non-renewal for all parcels below the ten (10) acres <br /> minimum parcel size will be required in conjunction with the contract. A fee for the recording of the <br /> Notice of Non-renewal is required. <br /> f. TRANSFER RESTRICTION: A Note shall be placed on the Parcel Map and a Notice of Minor <br /> Subdivision Restriction shall be recorded concurrently with the Parcel Map, with a reference to the <br /> instrument number of said recorded notice, stating that: <br /> The homesite shall not be transferred until April 20, 2014 April 20, 2024, or upon the death of an <br /> owner owning at least fifty (50) percent interest in the homesite parcel, unless the homesite parcel <br /> and the remainder parcel are merged pursuant to the provisions of the Development Title. <br />
