Kettleman Lane, Suite E
Lodi, CA 95242
SUBJECT: Response to Dillon & Murphy memo dated July 14, 2003
Dear Joe:
The Minor Subdivision application you submitted on January 21, 2003 is currently
pending due to issues with subdividing the 15-acre parcel while under Williamson Act
Contract. There are two options for the proposed project. Please discuss these with
your client and let me know how your client would like to proceed with the project. The
first option is to withdraw the application with the option of reinitiating the project within
eighteen (18) months with no fee requirements. The applicant can reinstate the project
by submitting a letter to the Community Development Department. The second option is
for the Community Development Department to approve the project with the condition
that the 5-acre and 10-acre parcels are non-buildable. If your client is unsatisfied with
the restriction, he may appeal the condition to the Planning Commission. Please let me
know what you intend to do by August 1, 2003.
In your memo dated July 14, 2003, you asked if your client would be allowed to build a
house on the property and then apply for a Minor Subdivision. The Community
Development Department has reviewed your question and determined that your
proposal would still be inconsistent with the intentions of the Williamson Act as
interpreted by County Counsel in the attached memo dated May 16, 2003. Please call
me with any additional questions.
Sincerely,
—'AJefe J'Ile
ssociate Planner
Cc: County Counsel
v
