There are two options for the proposed project. Please discuss these with <br /> your client and let me know how your client would like to proceed with the project. The <br /> first option is to withdraw the application with the option of reinitiating the project within <br /> eighteen (18) months with no fee requirements. The applicant can reinstate the project <br /> by submitting a letter to the Community Development Department. The second option is <br /> for the Community Development Department to approve the project with the condition <br /> that the 5-acre and 10-acre parcels are non-buildable. If your client is unsatisfied with <br /> the restriction, he may appeal the condition to the Planning Commission. Please let me <br /> know what you intend to do by August 1, 2003. <br /> In your memo dated July 14, 2003, you asked if your client would be allowed to build a <br /> house on the property and then apply for a Minor Subdivision. The Community <br /> Development Department has reviewed your question and determined that your <br /> proposal would still be inconsistent with the intentions of the Williamson Act as <br /> interpreted by County Counsel in the attached memo dated May 16, 2003.
