(2) The property shown on the Parcel Map is restricted from further subdivisions for <br />homesite purposes, except for financing only, by Section 9-610.3 of the San Joaquin <br />County Development Title. <br />e. BUILDING PERMIT: The owner shall obtain a building permit for a single family dwelling for each <br />homesite parcel concurrently with the approval of the parcel map. (Development Title Section 9- <br />610.3[a[[41) <br />f. SETBACKS: All structures must meet the following setback requirements from all new property <br />lines: <br />(1) All structures shall be a minimum of 10 feet from any side property line. (Development Title <br />Section 9-610.5) <br />(2) All main buildings shall be a minimum of thirty (30) feet from any new rear property line. <br />(Development Title Section 9-610.5) <br />(3) All accessory buildings shall be a minimum of fifteen (15) feet from any new rear property line. <br />(Development Title Section 9-610.5) <br />g. DEMOLITION PERMIT: The existing shed along the west property line of Parcel 2 does not meet <br />the setback requirements for the AG -40 zone. The shed will need a demolition permit to remove or <br />relocate the structure. <br />h. TREE PRESERVATION: Future development on the parcel(s) shall be consistent with the <br />requirements of the County's Tree Preservation Ordinance (Development Title Section 9-1505.2). <br />RIPARIAN HABITAT: Parallel to Paddy Creek, a natural open space area for riparian habitat <br />and waterway protection shall be maintained to provide nesting and foraging habitat and the <br />protection of waterway quality. The minimum width of said open space shall be one -hundred <br />(100) feet, measured from the mean high water level of the natural bank or fifty (50) feet back <br />from the existing riparian habitat, whichever is greater. Water -dependent uses may be permitted <br />in this buffer. The mean high water level and the edge of the riparian habitat shall be shown on <br />the Site Plan. The open space buffer required above shall be shown on the Parcel Map with the <br />following note: <br />(1) Pursuant to Section 9-1510.5 of the San Joaquin County Development Title, this area is <br />designated as a natural open space for riparian habitat and waterway protection. No <br />development other than water dependent uses shall be permitted in this space. <br />NOTE: The permanent Farm Labor Housing located on Parcel 1 is an accessory use to the existing <br />dairy. If Parcel 1 is sold separately from the dairy, or the housing is used for a purpose other than farm <br />labor for the dairy, then the housing may no longer be permitted. <br />2. COUNTY COUNSEL <br />a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the <br />subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and <br />employees from any claim, action, or proceeding against the local agency or its agents, officers, or <br />employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, <br />appeal board, or legislative body concerning a subdivision, which action is brought within the time <br />provided for in Section 66499.37 of the Government Code. <br />Conditions of Approval - 2 - PA -0400726 <br />
