Item No. 3 <br /> PC: 9-16-93 <br /> UP-93-12 <br /> Page 1 <br /> RECOMMENDATION <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Use Permit No. UP-93-12 with the Findings and Conditions of Approval given in the <br /> staff report. <br /> FINDINGS <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan <br /> and any applicable Specific Plan or Special Purpose Plan. <br /> • This finding can be made because the proposed stables are a conditionally permitted <br /> use in the AG-40 zone, which is an implementing zone of the General Agriculture <br /> General Plan designation. <br /> 2. Adequate utilities,roadway improvements,sanitation,watersupply, drainage,and othernecessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> This finding can be made because the site has access on Jack Tone Road via an <br /> existing driveway. Adequate area exists for water, storm drainage, and sewage <br /> disposal to be provided by an on-site well and an on-site septic system. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the site plan, along with the recommended <br /> conditions of approval,will ensure that all code requirements and other standards will <br /> be met. In addition, a manure management plan is required which will ensure that the <br /> number of horses is consistent with good waste management practices. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare <br /> or be injurious to the property or improvements of adjacent properties. <br /> This finding can be made because the Initial Study prepared for this Rem found no <br /> potentially significant environmental impacts. In addition, standard ordinance <br /> requirements will ensure that the site is operated in a healthy manner. <br /> 5. The use is compatible with adjoining land uses. <br /> This finding can be made because surrounding land Is primarily agricultural with <br /> scattered residences. The stable and corral are located adjacent to a creek and open <br /> agricultural land and the highway. Residents across the street and adjacent to the <br /> south will probably notice some odors but will not be significantly affected. <br />
