CONDITIONS OF APPROVAL PA-1100170 JAHANT WOODS CELLARS LP/BAUMBACH & PIAZZA Lot Line Adjustment Application No. PA-1100170 was approved by the San Joaquin County Community Development Department on December 5, 2011,which is the effective date of approval. Unless otherwise specified, all Ordinance requirements shall be complied with prior to approval of a Notice of Lot Line Adjustment. This approval will expire on June 5, 2013, which is 18 months from the effective date of approval, unless a Notice of Lot Line Adjustment has been recorded and a Record of Survey has been filed, if required by the Land Surveyor's Act. 1) COMMUNITY DEVELOPMENT DEPARTMENT (Contact Staff: John L. Funderburg,468-3160) a) APPROVAL: This approval is for a Lot Line Adjustment application among four parcels as shown on the site plan dated September 23, 2011. b) NOTICE OF LOT LINE ADJUSTMENT: A"Notice of Lot Line Adjustment' shall be recorded prior to conveyance of property through deeds by the owner. Legal descriptions of the resultant properties shall be submitted to the Surveyor's Division for review and forwarding to the Community Development Department. The legal descriptions shall be prepared, stamped and signed by a Registered Civil Engineer, qualified to practice Land Surveying per Section 8731 of the Land Surveyors'Act, or a Licensed Land Surveyor. (Development Title Section 9-872.4) c) FARMLAND SECURITY CONTRACT: The property owner shall rescind the current contracts and shall enter into new contracts prior to recording the Notice of Lot Line Adjustment. The "Notice of Lot Line Adjustment" shall not be recorded until the Farmland Security Contract has been deemed complete. Filing fees are required for this application. (Government Code Section 51257) d) LOT WIDTH: (The following requirements shall apply) i) Parcels Three and Four shall be a minimum of 330 feet in width, measured at the front yard setback line. (Development Title Section 9-610.4) ii) Parcels One and Two shall be a minimum of 150 feet in width. (Development Title Section 9- 610.4) e) LOT SIZE: (The following requirements shall apply) i) Parcels Three and Four shall be a minimum of 40.00 gross acres in size. (Development Title Section 9-872.2 (e)) ii) Parcels One and Two shall be a minimum of 2.0 gross acres in size. (Development Title Section 9-872.2 f) PLANNING APPLICATION PA-1100170: The "Notice of Lot Line Adjustment" for this Planning Application shall not be recorded prior to the recordation of the "Certificate of Compliance" for Planning Application PA-1100169. 2) DEPARTMENT OF PUBLIC WORKS: (Seethe attached memo dated October 4, 2011)
