V <br /> Analysis <br /> Background <br /> On January 22, 1991, the Board of Supervisors certified Environmental Impact Report No. ER-90-8 and <br /> approved Quarry Excavation Application No. QX-90-1 to permit the removal of 2.4 million tons of rock, sand, <br /> and gravel over a 10-year period on 120 acres located east of the project site. <br /> On April 28, 2000, the Community Development Department approved a 10 percent (12 acre) expansion of <br /> QX-90-1. <br /> On December 7, 2001, the Planning Commission approved QX-99-2 to permit the excavation of two million <br /> tons of sand and gravel on 69.5 acres located northeast of the project site. <br /> One letter in opposition was received from James Shannon, president of Educators Land Development <br /> Corporation, He expressed concerns regarding the slopes, aesthetics, and noise. <br /> slopes <br /> Educators Land Development owns the property on the on the bluff and some of the lowland, southeast of <br /> the project site. Mr. Shannon intends to develop that property, which is zoned Rural Residential (R-R), and <br /> construct a storm drainage pond on the lower property, adjacent to the quarry site. The proposed <br /> excavation would result in a 12-foot difference in elevation between the two properties. He is concerned <br /> that this difference in elevation could destabilize the area where he may propose a pond. <br /> The excavation will have a maximum final slope of 2:1, and the minimum setback of the excavation from <br /> property lines is 25 feet. The Community Development Department reviewed this issue and determined that <br /> the proposed excavation would not have a significant impact on the adjacent property relative to soil <br /> stability. <br /> Aesthetics <br /> Because the excavation site is located below the bluff, it does not lend itself to visual screening. However, <br /> the project does include continuous reclamation, which will reduce the amount of land that will be in <br /> excavation at any given time. The project is located approximately 1,000 feet from State Route 12188, and <br /> no screening is required between the State Route and the project. <br /> Noise <br /> The southeast portion of this project is located adjacent to vacant land designated Rural Residential (RIR) <br /> on the General Plan and zoned Rural Residential (R-R). Section 9-1025.9(b)(2) of the Development Title <br /> requires development projects to mitigate noise levels from these projects so that the resulting noise level <br /> does not exceed 65 dB Ldn at the outdoor activity area of a residential use. The outdoor activity areas for <br /> future lots in the Rural Residential property will likely begin at or near the top of the bluff, which is a <br /> minimum of 150 feet from the nearest excavation activity. The primary noise source for quarries is <br /> usually the processing plant. The processing plant for this site is located north of the Mokelumne River, <br /> more than 1500 feet from the residential area. The nearest noise sensitive receptor(residence) is located <br /> approximately 800 feet from the excavation site.
