CONDITIONS OF APPROVAL <br /> PA-1000155 <br /> Phillips <br /> Minor Subdivision'.Application No. PA-1000155 was approved by the San Joaquin County <br /> Community Development Department on September 3, 2010. The effective date of approval is <br /> September 13, 2016.- This tentative map approval will expire on September 12, 2013, which is three <br /> years from the effective date of approval, unless (1) all Conditions of Approval have been complied <br /> with and (2)a Parcel`Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of,the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact. Kevin Swanson, 209-468-9653) <br /> a. TENTATIVE]MAP: The Parcel Map shall substantially conforms with the approved tentative map <br /> dated Augusk30, 2010. <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note <br /> shall be placed on the Parcel Map and recorded as a separate instrument: <br /> (1) All persons purchasing lots within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities, <br /> such as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniencies or discomforts shall not be considered to be a nuisance. <br /> c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to,this map: <br /> (1) Parcel 1Jshall have a minimum lot width of 330 feet, measured at the front yard setback line. <br /> (Development Title Section 9-610.4) <br /> (2) Parcel 2:shall be between two(2) net acres and five (5)gross acres in size. (Development Title <br /> Section 9-610.3[x](2)) <br /> (3) Parcel Z<shall have a minimum lot width of 150 feet. (Development Title Section 9-610.4) <br /> i <br /> d. TRANS FEWRESTRICTION FOR PARCEL 2: A Note shall be placed on the Parcel Map and a <br /> Notice of Minor Subdivision Restriction shall be recorded for Parcel 1 concurrently with the Parcel <br /> Map, with a reference to the instrument number of said recorded notice, stating that: <br /> (1) The homesite shall not be transferred until September 13, 2020, or upon the death of an <br /> owner owning at least fifty (50) percent interest in the homesite parcel, unless the <br /> homesite,parcel and the remainder parcel are merged pursuant to the provisions of the <br /> Development Title. <br /> (2) The property shown on the Parcel Map is restricted from further subdivisions for <br /> homesite,purposes, except for financing only, by Section 9-610.3 of the San Joaquin <br /> County Qevelopment Title. <br /> Conditions of Approval - 1 - PA-1000155 <br />
