This area has been subject to historic flooding,therefore all new structures and/or substantial <br /> improvements constructed on all parcels shall be elevated a minimum of two(2)feet above the <br /> adjacent grade. <br /> 5. The applicant shall keep Bear Creek(Creek)free of all obstacles which impede the flow of <br /> water, and any alteration to the Creek will require obtaining a Watercourse Encroachment Permit <br /> from the San Joaquin County Department of Public Works. Additionally,no structures,fences, <br /> or poles shall be constructed within 25-feet of the top of either banks of the Creek without the <br /> approval of the Department of Public Works. <br /> 6. The Parcel Map shall show a twenty-five(25)foot building setback from the top of both banks of <br /> the Creek. <br /> Note: A State NPDES Construction Permit Notice of Intent(NOI)shall be filed with the State Water <br /> Resources Control Board if over one(1)acre of total ground is disturbed. <br /> DG:SH:ar <br />
