Recommendations
Action
It is recommended that the Planning Commission:
1. Approve the Negative Declaration; and
2. Approve Site Approval Application No. PA-03-14 with the Findings and Conditions of Approval
contained in the staff report.
Findings
1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan,
any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan
adopted by the County.
• This finding can be made because the Agricultural Waste use type may be conditionally
permitted in the AG-40 zone with an approved Site Approval. The AG-40 zone is an
implementing zone for the A/G General Plan designation. No other plans apply.
2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary
facilities have been provided, and the proposed improvements are properly related to existing and
proposed roadways.
This finding can be made because adequate utilities, access roads, sanitation, drainage,
and other necessary facilities will be provided pursuant to the conditions of approval, and
the proposed improvements will be properly related to existing and proposed streets and
highways. There will be no need for changes in supply of utilities or water. The Public
Works Department is requiring an Encroachment Permit for improvements to the access
s road that include paving the first 100 feet. The Environmental Health Department is
requiring improvements for sanitation and drainage that include a permanent restroom
and a detailed drainage plan.
3. The site is physically suitable for the type of development and for the intensity of development.
• This finding can be made because the 160-acre property involved is of adequate size and
shape to accommodate one acre of windrows along with all yards, building coverage,
setbacks, parking areas, and other requirements of this Title. The surrounding vineyards
owned by the applicant will accommodate all compost made on the site.
4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be
injurious to the property or improvements of adjacent properties.
• This finding can be made because an Initial Study prepared for this project found no
potentially significant environmental impacts. Conditions of Approval from the Clements
Fire District concerning fire breaks, the Public Works Department concerning flood issues,
and the Environmental Health Department concerning water and groundwater issues
ensure that the project will not have any significant environmental impacts.
San Joaquin County
PA-03-14\Good Earth Farms
Community Development Page 5
