The project is located at the north end of <br /> Kennefick Road in the flood plain of Dry Creek northeast of Lodi <br /> in San Joaquin County. The project consists of a plan to create <br /> two fish ponds covering 14 acres . The ponds will be 13 to 15 <br /> feet deep. <br /> Wildlife habitat conditions consist of a nonirrigated <br /> pasture which is bisected by a dry flood channel of Dry Creek. <br /> The project site is a short distance south of the main channel of <br /> Dry Creek. DFG records indicate the presence of Swainson's hawk <br /> nest sites within a five mile radius of the project site. <br /> The DFG will concur with a finding for a Mitigated Negative <br /> Declaration pursuant to the California Environmental Quality Act <br /> if the mitigation measures attached to the subject Initial Study <br /> for SA-92-41 are made a condition of project approval. <br /> Additionally, the applicant should be advised it will be <br /> necessary to secure a E <br /> RoggMam pursuant to <br /> section 1600 et seq. of the Fish and Game Code, p-r-fo-k to any <br /> construction activity occurring within the 100-year flood plain <br /> of any waterway. <br /> This project will have an impact to fish and/or wildlife <br /> habitat. s e er Public Resources Code Section <br /> 21089 and ashed yis and Game Code Section 711. 4 is <br /> necessary. Fees are payable by the projectapplicant- upon-filing <br /> of the Notice of Determination by -the lead agency. - <br />
