CONDITIONS OF APPROVAL <br /> PA-0400358 <br /> Herbert <br /> Minor Subdivision Application No. PA-0400358 was approved by the San Joaquin County <br /> Community Development Department on August 18, 2004. The effective date of approval is August <br /> 28, 2004. This tentative map approval will expire on August 28, 2007, which is three years from the <br /> effective date of approval, unless (1) all Conditions of Approval have been complied with and (2) a <br /> Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified, and other Ordinance requirements may apply. <br /> 1_ COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Kathy Allen, [209] 953-7509) <br /> a. TENTATIVE MAP: The parcel map shall substantially conform with the approved tentative map <br /> dated June 22, 2004 <br /> b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) All parcels shall have a minimum lot width of 330 feet, measured at the front yard setback line. <br /> (Development Title Section 9-610.4) <br /> (2) Parcel one shall have a minimum of 40 acres. (Development Title Section 9-610.2) Parcel two <br /> shall have a minimum of 36 acres, pursuant to Deviation Application No. PA-0400273. <br /> C. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-900(b), the following note shall <br /> be placed on the Parcel Map: <br /> (1) All persons purchasing lots within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities, <br /> such as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniencies or discomforts shall not be considered to be a nuisance. <br /> d. ACCESS: The following access requirements apply and shall be shown on the Parcel Map: <br /> (1) A proposed 25-foot wide private easement for access to parcel two, along parcel one, shall be <br /> shown on the Parcel Map. (Development Title Section 9-1150.15) <br /> (2) The following note shall be placed on the Parcel Map and also shall be recorded as a separate <br /> instrument: <br /> A. At the time of development of parcel two, the entire length of the private right-of-way for <br /> parcel two shall be constructed and maintained to the standards required by Section 10.207 <br /> of the Uniform Fire Code and applicable San Joaquin County Improvement Standards. <br /> (Development Title Section 9-1150.15[c]) <br /> Conditions of Approval - 1 - PA-0400358 <br />
