CONDITIONS OF APPROVAL <br /> PA-0800028 <br /> DHV, LLC <br /> Minor Subdivision Application No. PA-0800028 was approved by the San Joaquin County <br /> Community Development Department on September 15, 2008. The effective date of approval is <br /> September 25, 2008. This tentative map approval will expire on September 25, 2011, which is three <br /> years from the effective date of approval, unless (1) all Conditions of Approval have been complied <br /> with and (2) a Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Patrick Crosby, [209] 468-8597) <br /> a. TENTATIVE MAP: The Parcel Map shall substantially conform to the approved tentative map <br /> dated January 22, 2008. <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note <br /> shall be placed on the Parcel Map: <br /> (1) All persons purchasing lots within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities, <br /> such as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniencies or discomforts shall not be considered to be a nuisance. <br /> c. LOT SIZE: Each parcel shall have a minimum lot area of forty (40) acres. (Development Title <br /> Section 9-610.2) <br /> d. TREE PRESERVATION: Future development on the parcel(s) shall be consistent with the <br /> requirements of the County's Tree Preservation Ordinance (Development Title Section 9-1505.2). <br /> (1) The following note shall be placed on the Parcel Map and also shall be recorded as a separate <br /> instrument: <br /> A. The removal of a Native Oak Tree, Heritage Oak Tree, or Historical Tree shall require an <br /> approved Improvement Plan application. Replacement of any tree removed under <br /> Development Title Section 9-1505.3 shall be as specified in Section 9-1505.4. <br /> e. ACCESS: The following access requirements apply and shall be shown on the Parcel Map: <br /> (1) A proposed 25-foot wide private easement for access to Parcels 3 and 4 shall be shown on <br /> the Parcel Map. (Development Title Section 9-1150.15) <br /> (2) The following note shall be placed on the Parcel Map and also shall be recorded as a <br /> separate instrument: <br /> A.
