3 . FEE TO BE PAID: $ 4, 000 (See special provisions) 4 . TIME OF PAYMENT: Work will be billed as the same progresses and all bills shall be paid on or before Thirty days from the date of billing; upon completion of the work, a final bill will be submitted and the same will be due and payable as of the day said work is completed. S. TIME: After the acceptance of this work order, the said work will be commenced by SKW AND ASSOCIATES after receiving the preliminary title report, and the work included herein will be completed based on the time required by the County agencies to complete and approve the map. 6. GENERAL TERMS AND CONDITIONS: a) Unless otherwise herein provided, said work will be performed and billed on time and materials basis at the prevailing rates as said work progresses . b) The Owner agrees that all sums owing to the Engineer past due shall accrue and the Owner shall pay a service charge upon such past due sums equal to one percent (1%) per month of such past due sums (12% per annum) . c) In the event SKW AND ASSOCIATES employs legal counsel to enforce any provision hereof, they shall be entitled to collect all expenses connected therewith including reasonable attorney' s fees . d) The work produced pursuant to this agreement therein shall be and remain the property of the engineer and shall not be used by any ether party on any other or additional project except upon written consent of the engineer. e) Any changes or additions from the original work agreement shall be billed on a time and material basis from the Engineer to the Owner, and all provisions in these General Terms and conditions shall apply. All changes and additions from the original work shall be communicated to the Engineer by writing executed by the Owner. f) In the event of cancellation after the acceptance of this work agreement, the Cwner shall reimburse the Engineer for all expenses incurred up to the time of the cancellation plus compensation for loss of profit as
