Analysis <br /> Lot Size Averaging <br /> The tentative map shows six lots, including the designated remainder, that are forty acres gross <br /> in size. Lot 1 is shown as 5.0 gross acres, Lot 2 is shown as 36.56 gross acres, and Lot 3 is <br /> shown as 38.73 gross acres. <br /> Eight parcels, proposed Lots 2 through 8 and the designated remainder, use Development Title <br /> Section 9-610.3(f) Parcels Based on Lot-Size Averaging and the ninth parcel, Parcel 1, uses <br /> Development Title Section 9-610.3(a) Homesite Parcels The section using lot size averaging <br /> states that parcels of land containing up to ten percent less area than the minimum required <br /> may be created from an original parcel, subject to the following conditions: <br /> 1) The overall average parcel area of the proposed subdivision is equal to or greater than <br /> the minimum parcel area required in Table 9-610.2; and <br /> 2) The proposed subdivision of property complies with Sections 51230.1 and 66474.4 of <br /> the Government Code if the property to be divided is under a Williamson Act contract. <br /> This subdivision meets these requirements. All proposed parcels that are under Williamson Act <br /> contract are forty acres in size. Eight parcels that are each over 36 acres are being proposed <br /> using the lot size averaging provision. The ninth parcel, Parcel 1, is proposed to be created from <br /> proposed Parcel 2 using the Homesite Parcel provision. <br /> Homesite Parcel <br /> Parcel 1 uses Development Title Section 9-610.3(a) Homesite Parcels for the creation of the <br /> five (5) -acre homesite. Proposed Parcel 1 is being created from Parcel 2. Homesite parcels <br /> may be created in the General Agriculture zone provided that all of the following provisions are <br /> satisfied. <br /> 1. Not more than one homesite may be created from an existing parcel. <br /> 2. The Homesite parcel shall contain not less than two (2) acres nor more than five (5) <br /> acres. <br /> 3. A Minor Subdivision application proposing the creation of a Homesite parcel from an <br /> existing parcel shall not be approved by the Review Authority if the owner of the existing <br /> parcel has owned the existing parcel for less than ten (10) years. If the Homesite parcel <br /> is approved, the homesite parcel which is created shall not be transferred for a period of <br /> ten (10) years following the date of its approval or upon the death of an owner owning at <br /> least fifty (50) percent interest in the Homesite parcel, unless the Homesite parcel and <br /> the remainder parcel (Parcel 2) are merged pursuant to this Title. <br /> 4.
