Recommendations
Action
It is recommended that the Planning Commission:
1. Adopt "CEQA Findings" including the "Statement of Overriding Considerations"
(Attachment A)
2. Certify as adequate Final Environmental Impact Report No. PA-0200065 (CEMEX Vernalis
Quarry, State Clearinghouse No. 2002122122);
3. Adopt the "CEMEX Vernalis Quarry Project (QX-01-0002) Mitigation Monitoring and
Reporting Program" (Attachment B)
4. Approve Quarry Excavation Application No. QX-01-0002 with the Findings, Williamson Act
Principles of Compatibility, and Conditions of Approval contained in the staff report; and
5. Adopt the CEMEX Vernalis Reclamation Plan dated November 2003, as modified by the
CEMEX Vernalis Quarry FEIR and with the conditions of Approval contained in the Staff
Report.
Project Findings
The proposal is for the removal of regionally significant or scarce deposits of mineral resources and not for
removal of prime farm land.
• This finding can be made because the proposed project site has been identified as having
significant deposits of sand and gravel by the Department of Conservation (Division of
Mines and Geology) and classified within a Mineral Resource Zone (MRZ-2 and MRZ-3).
Specifically, the site is being mined for sand and gavel materials and will not result in the
removal of prime farmland because the topsoil will be temporarily stockpiled and used to
reclaim the site back to agriculture.
The proposed reclamation of the property upon completion will leave the property in a condition, which will
allow its reuse.
• This finding can be made because the top soil will be returned to the site and the site will be
reclaimed to agriculture in accordance with the approved Reclamation Plan.
Issuance of the permit shall not be significantly detrimental to the public health, safety, or welfare, or be
injurious to he property or improvements to the vicinity.
• This finding can be made because there will be no excavation below the ground water table,
and potable water services are to be provided for employees. The significant and
unavoidable impacts associated with noise and air quality are overridden by the benefit to
the County of mining a significant extractive resource deposit.
San Joaquin County QX-01-2\Lonestar California
Community Development Page 20
