Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Adopt "CEQA Findings" including the "Statement of Overriding Considerations" <br /> (Attachment A) <br /> 2. Certify as adequate Final Environmental Impact Report No. PA-0200065 (CEMEX Vernalis <br /> Quarry, State Clearinghouse No. 2002122122); <br /> 3. Adopt the "CEMEX Vernalis Quarry Project (QX-01-0002) Mitigation Monitoring and <br /> Reporting Program" (Attachment B) <br /> 4. Approve Quarry Excavation Application No. QX-01-0002 with the Findings, Williamson Act <br /> Principles of Compatibility, and Conditions of Approval contained in the staff report; and <br /> 5. Adopt the CEMEX Vernalis Reclamation Plan dated November 2003, as modified by the <br /> CEMEX Vernalis Quarry FEIR and with the conditions of Approval contained in the Staff <br /> Report. <br /> Project Findings <br /> The proposal is for the removal of regionally significant or scarce deposits of mineral resources and not for <br /> removal of prime farm land. <br /> • This finding can be made because the proposed project site has been identified as having <br /> significant deposits of sand and gravel by the Department of Conservation (Division of <br /> Mines and Geology) and classified within a Mineral Resource Zone (MRZ-2 and MRZ-3). <br /> Specifically, the site is being mined for sand and gavel materials and will not result in the <br /> removal of prime farmland because the topsoil will be temporarily stockpiled and used to <br /> reclaim the site back to agriculture. <br /> The proposed reclamation of the property upon completion will leave the property in a condition, which will <br /> allow its reuse. <br /> • This finding can be made because the top soil will be returned to the site and the site will be <br /> reclaimed to agriculture in accordance with the approved Reclamation Plan. <br /> Issuance of the permit shall not be significantly detrimental to the public health, safety, or welfare, or be <br /> injurious to he property or improvements to the vicinity. <br /> • This finding can be made because there will be no excavation below the ground water table, <br /> and potable water services are to be provided for employees.
