Three artificial overflow <br /> irrigation basins,which collect excess irrigation from the orchards onsite,exhibit wetland <br /> characteristics such as a prevalence of hydrophytic vegetation,wetland hydrology, and hydric — <br /> soils. However,these basins are hydrologically disconnected from any waters of the United States <br /> and may, therefore,be considered"isolated"from navigable waters vis-a-vis the SWANCC <br /> decision and may not be considered jurisdictional waters of the United States.In addition,these <br /> basins are artificially irrigated areas and would revert to uplands if the irrigation ceased.Finally, <br /> these basins are likely to have been built in former uplands,based on topography and soil — <br /> mapping of upland soils. <br /> Other Waters of the United States—Ephemeral Channels — <br /> According to the Corps, an ephemeral channel has flowing water only during, and for a short <br /> duration after,precipitation events in a typical year. Ephemeral stream beds are located above the <br /> water table year-round. Groundwater is not a source of water for the stream. Runoff from rainfall <br /> is the primary source of water for stream flow. <br /> One ephemeral channel,Hospital Creek, was identified in the study area. This channel,which <br /> eventually drains to Lateral 5 North,averages approximately 19 feet wide and is approximately <br /> 5,466 feet long within the study area. Its area is approximately 2.38 acres.This generally low- <br /> gradient channel is bordered by agricultural land and annual grassland. Bed material consists of <br /> sand, cobbles,and fine and medium gravels and is vegetated by annual grassland species. <br /> 4.2.5 Conclusions <br /> Approximately 2.38 acres(5,466 linear feet)of other waters of the United States were identified <br /> in the study area. The three artificial overflow irrigation basins within the study area were <br /> determined to likely be non jurisdictional. — <br /> This report documents the wetland boundary delineation and best professional judgment of ESA <br /> investigators.
