Noise <br /> Several residences are located near the site and along studied haul routes(figure 4.5-2). The EIR <br /> determined that mining activities, plant operations and truck traffic will generate noise levels that exceed the <br /> County's noise standards. The EIR developed four feasible mitigation measures (see MMRP, page 5A, <br /> Mitigation Measures 4.5.1.a-d). However, even with these measures, the EIR determined that it is likely that <br /> noise levels could still exceed County standard of 50 dBA Leq at the exterior property line of the three <br /> residences nearest to the project site(R3, R4, and R5). Noise impacts after mitigation remain significant. <br /> Land Use <br /> The EIR found that the project has the potential to conflict with existing and planned land uses surrounding <br /> the project site. However, application of the proposed mitigation measures will reduce that impact to less <br /> than significant. The EIR found that the project was consistent with applicable Land Use designations and <br /> policies. The EIR found that the project was consistent with the Surface Mining and Reclamation Act. The <br /> EIR found that the project would conform to the San Joaquin County Multi-Species habitat Conservation <br /> Plan by either participating in the plan or implementing equivalent mitigation measures described in Section <br /> 4.9, Biological Resources(See MMRP, page 5-8, Mitigation Measures 4.9.2a-c). Land Use impacts are <br /> less than significant after mitigation. <br /> Traffic <br /> The EIR reviewed three haul routes. Haul route 2 proved unworkable. The applicant is proposing the use <br /> of haul route 1 on a permanent basis, and haul route 3 as a temporary option until the interchange at SR <br /> 132 and Bird Road is constructed. Haul Routes 1 and 3 are shown in figures 4.2 and 4.3. The EIR <br /> determined that traffic impacts could be reduced to less than significant with several mitigation measures <br /> (see MMRP page 5-3, mitigation measures 4.4.1 a-e, 4.5.3). However, the Department of Public Works is <br /> recommending that haul route 3 be used only during the ground preparation phase of the project, and that <br /> no material is to be excavated until the interchange is completed. Construction of the interchange requires <br /> the cooperation of several excavators in the area. The Department of Public Works does not want any <br /> more excavation to be approved until the interchange is constructed. At his time, the financing for <br /> construction has not been completed. <br /> Agriculture <br /> The EIR found that the project would not conflict with the existing agricultural zoning of the subject <br /> properties nor with the provisions of an existing Williamson Act contract(See Williamson Act below). The <br /> EIR determined that the mining activities have the potential to result in offsite impacts to adjacent <br /> agricultural lands. However, implementation of Mitigation Measure 4.3.3 (dust control measures)would <br /> reduce that impact to less than significant. The EIR found that deep pit aggregate extraction will reduce the <br /> agricultural productivity of the project site. However, modification of the Reclamation Plan to incorporate <br /> elements of a comprehensive soil resource extraction, maintenance and reintroduction plan would reduce <br /> that impact to less than significant(see MMRP, page 5-2, Mitigation Measure 4.3.4). Agricultural impacts <br /> after mitigation are less than significant. <br /> Williamson Act <br /> Phases II and III (APNs 265-010-15 and 16)are under Williamson Act Contract. A Notice of Nonrenewal <br /> was approved for both parcels in October 2004. Those properties will be out of contract in 2015. Quarries <br /> are compatible uses under Williamson Act Contract provided that the land is rehabilitated for agricultural <br /> use, as is proposed (Section 9-1810.3[b][1][W]).
