ENVIRONMENTAL ANALYSIS <br /> w 4.5 NOISE <br /> ` U.S. DEPARTMENT OF LABOR, MINE SAFETY AND HEALTH <br /> ADMINISTRATION (MSHA) <br /> The mission of the Mine Safety and Health Administration(MSHA) is to administer the <br /> provisions of the Federal Mine Safety and Health Act of 1977 (Mine Act)and to enforce <br /> compliance with mandatory safety and health standards as a means to eliminate fatal accidents;to <br /> reduce the frequency and severity of nonfatal accidents; to minimize health hazards; and to <br /> promote improved safety and health conditions in the Nation's mines.MSHA carries out the <br /> mandates of the Mine Act at all mining and mineral processing operations in the United States, <br /> ti regardless of size,number of employees, commodity mined,or method of extraction. <br /> MSHA's new noise standards (1999)require mine operators to monitor workplace noise exposure <br /> .. and provide for miners and their representatives to observe the monitoring. The standards <br /> establish several levels requiring mine operators to take action: <br /> r. • Miners exposed to an average sound level of 85 decibels(85 dBA)or more over an 8—hour <br /> period must be enrolled in a hearing protection program, which will include special <br /> training,hearing tests,and hearing protection. <br /> ` • If workplace noise levels reach 90 dBA or more over an 8—hour period, mine operators <br /> must use feasible engineering and administrative controls to reduce noise levels. Hearing <br /> protectors are required to he provided and worn if the permissible exposure level cannot be <br /> achieved using feasible engineering and administrative controls. <br /> • At workplace noise levels of 105 dBA or more over an 8—hour period,mine operators must <br /> ensure the use of both ear plug and earmuff type hearing protectors. <br /> • At no time during the work shift may noise levels exceed 115 dBA. <br /> SAN JOAQUIN COUNTY DEVELOPMENT TITLE <br /> y, Chapter 9, Section 1025.9 of the San Joaquin County Development Title includes maximum <br /> allowable noise exposure levels for transportation and stationary sources,as shown in Table 4.5-1, <br /> Parts I and H. <br /> s <br /> The San Joaquin County Development Title also includes the following provisions,which are <br /> applicable to this project: <br /> (a) (2) Private development projects that include the development of new transportation <br /> facilities or the expansion of existing transportation facilities shall be required to <br /> mitigate the noise levels from these transportation facilities so that the resulting noise <br /> 6. levels on noise sensitive land uses within and adjacent to said development projects do <br /> not exceed the standards specified in Table 4.5-1,Part I. <br /> ..
