authority to enforce provisions of the Surface Mining and Reclamation Act. The County may <br /> exercise all enforcement regulations available under the County Development Title and the State <br /> Public Resources Code. Such enforcement measures include charging the applicant the costs of <br /> administering an enforcement action. The basis for charging fees for an enforcement action shall be <br /> a time and materials compensation. (Development Title Section 9-1415.3[t]) <br /> 2. DEPARTMENT OF PUBLIC WORKS (Staff Contact: Gabriel Karam, 468-3000) <br /> a. The excavation plan shall be prepared by a Registered Civil Engineer or Land Surveyor and include <br /> the following: <br /> (1) Detail of access road (first 100 feet from Koster Road shall be paved). <br /> (2) A plan of the export haul routes for County roads. <br /> (3) Stockpile area for top soil. No excavation or stockpile shall be allowed within 25 feet of the <br /> property boundary or the County right-of-way. <br /> b. All private roads involved in an excavation shall be maintained as to control dust. <br /> c. A video tape of the planned haul routes showing conditions of all San Joaquin County roads shall be <br /> submitted to Public Works. The condition of County maintained roads along the haul route shall be <br /> reviewed by Public Works prior to the start of excavation. (Development Title Section 9-1415.2) <br /> d. Loads on all public roads shall be limited to legal loads only. (Vehicle Code Section 35551) <br /> e. An encroachment permit shall be required for work within public road rights-of-way. (Development <br /> Title Sections 9-1145.4 and 9-1145.5) <br /> f. A haul route shall be approved by Public Works from the project site to the State Highway. The <br /> portion of Blewett Road east of Koster Road north of Blewett Road shall not be considered as the <br /> haul route for the project. An engineering study of County roadways used as haul routes shall be <br /> required. The engineering study shall determine the adequacy of roadway width requirements, <br /> structural section, R-value, traffic index, overall safety, and shoulder requirements. The study shall <br /> be based on cumulative traffic generation of existing and future mining operations in the Vernalis <br /> area. The report shall also recommend improvements required to County roads to mitigate the <br /> increased truck traffic to comply with the County level of service standards on roadways and <br /> intersections. The applicant shall also be required to do all mitigations required by the engineering <br /> study. <br /> g. A security bond or other instrument in the amount and form acceptable to Public Works shall be <br /> deposited with the Department. The bond will guarantee that if the permittee fails, refuses, or <br /> neglects to repair under permit any damages to any County roads along the haul route resulting from <br /> permittee's operation, Public Works may use the funds to restore County roads to equal or better <br /> than original condition. The amount of deposit or security required may be adjusted at the discretion <br /> of the Director of Public Works. The cash deposit or security shall be replenished or adjusted <br /> following any payment to the County for work performed or to provide for additional future work that <br /> may be required. (Development Title Section 9-854.3) <br /> h. A Maintenance Agreement shall be executed by the applicant to ensure that Koster Road (including <br /> all bridges on haul routes), Blewett Road, and any other County roads utilized as a haul route is <br /> maintained to a condition acceptable to San Joaquin County.
