4. ENVQLONPIENTALANALYSIS <br /> 4.9 BIOLOGICAL RESOURCES <br /> d) Restoring or enhancing occupied habitat on-site or at another regional location; and/or <br /> e) Protecting occupied habitat for the species on-site or at another regional location. <br /> Mitigation Measures 4.9.2f. For Phases of the Proposed Project that are located entirely <br /> within San Joaquin County,the applicant may be able to comply with the SJMSCP in lieu <br /> of implementing Mitigation Measures 4.9.2a-e. Complying with the SJMSCP would <br /> provide for pre-construction surveys,impact avoidance and minimization measures,and <br /> preservation of open space as mitigation. <br /> Significance after Mitigation: Less-than-significant. <br /> Impact 4.93: The Proposed Project will not conflict with any applicable habitat <br /> conservation plan or natural community conservation plan. This would be a less-than- <br /> significant impact. <br /> The Proposed Project will either comply with the SJMSCP, or will provide avoidance and <br /> mitigation measures commensurate with the SJMSCP. For this reason,the Proposed Project <br /> would result in a less-than-significant impact. <br /> Mitigation Measure: No mitigation is required. <br /> Impact 4.9.4: The Proposed Project will not have a substantial adverse effect on any <br /> riparian habitat or other sensitive natural community identified in local or regional plans, <br /> policies,regulations or by the CDFG or USFWS. This would be a less-than-significant <br /> impact. <br /> Under Haul Route Option 2, Hospital Creek(a highly modified and re-directed channel) would <br /> not be protected by any setback and would be mined. Elements of riparian habitat and <br /> scalebroom scrub occur on Hospital Creek within the Proposed Project area. However,these <br /> elements are dispersed and do not comprise intact plant communities. Impacts to these elements <br /> under Haul Route Option 2 of the Proposed Project would result in a less-than-significant <br /> impact. <br /> Mitigation Measure: No mitigation is required. <br /> Impact 4.9.5: The Proposed Project will not interfere substantially with the movement of <br /> any native resident or migratory fish or wildlife species or with established native resident <br /> or migratory wildlife corridors,or impede the use of native wildlife nursery sites.
