4. ENVIRONWNTAL ANALYSIS <br /> 4.11 HAZARDS AND HAZARDOUS MATERIALS -- <br /> substances (as well as other hazards). Fed/OSHA also establishes criteria by which each state can <br /> implement its own health and safety program. <br /> Hazardous Materials Transportation <br /> The DOT regulates the interstate transport of hazardous materials and wastes through <br /> implementation of the Hazardous Materials Transportation Act. This act specifies driver-training <br /> requirements, load labeling procedures,and container design and safety specifications. <br /> Transporters of hazardous wastes must also meet the requirements of additional statutes such as <br /> RCRA. <br /> State <br /> The California Environmental Protection Agency(Cal/EPA) and the Office of Emergency <br /> Services(OES)of the State of California establish rules governing the use of hazardous <br /> substances. The SWRCB has primary responsibility to protect water quality and supply. <br /> The Cal/EPA was created in 1991 to better coordinate state environmental programs,reduce <br /> administrative duplication, and address the greatest environmental and health risks. The Cal/EPA <br /> unifies the state's environmental authority under a single accountable,Cabinet-level agency. The <br /> Secretary for Environmental Protection oversees the following agencies: Air Resources Board, <br /> Integrated Waste Management Board,Department of Pesticide Regulation, State Water _ <br /> Resources Control Board,Department of Toxic Substances Control,and Office of Environmental <br /> Health Hazard Assessment. <br /> Applicable State laws include the following: <br /> • Porter Cologne Water Quality Control Act(California Water Code Section 13000-14076 <br /> 23 CCR) <br /> • California Accidental Release Prevention Law(California Health and Safety Code Section <br /> 25531 et seq./ 19 CCR) — <br /> • California Building Code(California Health and Safety Code Section 18901 et seq./24 <br /> CCR) <br /> • California Fire Code(California Health and Safety Code Section 13000 et seq./ 19 CCR) <br /> • California Occupational Safety and Health Act(California Labor Code Section 6300-6718 <br /> 8 CCR) <br /> • Hazardous Materials Handling and Emergency Response "Waters Bill" (California Health and Safety Code Section 25500 et seq./ 19 CCR) <br /> • Hazardous Waste Control Law(HWCL)(California Health and Safety Code Section 25100 _ <br /> et seq./22 CCR) <br /> RMC Pack Vernalis Quany Mining and Reclamation Project 4.11-8 FSA/203015 <br /> Adminisva c Daft F.at Match 2004 <br />
