6. OTHER STATUTORY CONSIDERATIONS <br /> HAZARDS AND HAZARDOUS MATERIALS <br /> There are no significant cumulative hazards and hazardous materials impacts. <br /> 6.3 SIGNIFICANT UNAVOIDABLE ADVERSE IMPACTS <br /> 6.3.1 INTRODUCTION <br /> The CEQA Section 21100(b)(2)and CEQA Guidelines Section 15126.2(6) require that any <br /> significant and unavoidable effect on the environment must be identified. In addition, Section <br /> 15093(a)of the CEQA Guidelines allows the decision-making agency to determine if the benefits <br /> of a Proposed Project outweigh the unavoidable adverse environmental impacts of implementing <br /> the project. The County can approve a project with unavoidable adverse impacts if it prepares <br /> and adopts a "Statement of Overriding Considerations" setting forth the speck reasons for <br /> making such a judgment. A list of unavoidable adverse impacts identified in this EIR is provided <br /> below. For each of the unavoidable adverse impacts,the County must prepare and adopt a <br /> Statement of Overriding Considerations if the County approves the project. <br /> 6.3.2 UNAVOIDABLE ADVERSE IMPACTS <br /> LAND USE <br /> The impacts discussed below regarding Agricultural Resources,Air Quality,Hydrology and <br /> Water Quality,and Visual Resources are significant and unavoidable. Therefore, land use <br /> impacts associated with these resource sections are considered significant and unavoidable. <br /> AGRICULTURAL RESOURCES <br /> Implementation of the Proposed Project would result in the conversion of prime farmland and <br /> .. farmland of statewide importance. Even with the mitigation of the applicant or successors-in- <br /> interest funding an agricultural land easement through the American Farmland Trust(or other <br /> suitable organization)and proposed reclamation to agricultural, since the unaltered prime farm <br /> land can never be replaced,the Proposed Project would result in a significant and unavoidable <br /> adverse impact on local and regional agricultural resources. <br /> HYDROLOGYAND WATER QUALITY <br /> Mining out Hospital Creek and constructing a berm to form a large detention basin(Haul Route <br /> Option 2)would substantially alter the natural hydrology of Hospital Creek. This option would <br /> permanently remove surface water flows from the reach of Hospital Creek downstream of the <br /> proposed mining operations leading to depletion of flows to downstream receiving water bodies, <br /> reduction of surface water available for localized infiltration, or elimination of adequate water <br /> flow for aquatic and riparian habitats. Removal of Hospital Creek from within the boundaries of <br /> the project site could result in adverse impacts to downstream hydrology and recharge and there <br /> RMC Pacx&Vemahs Quany Mining and Reclamation Project 6-15 FSA/703015 <br /> Adminisu Ww Draft FIL Mara 2004 <br /> a. <br />
