Hazelton Ave. Stockton, CA 95205 Art: Leanne Mueller, Re: QX-01-2 Dear Ms. Mueller: In response to the Application Referral on the Lonestar proposal, QX-01-2, my comments follow: 1) Gravel is an important asset to the region and extraction of that asset from the propetry is appropriate with limitations. 2) It is difficult to determine the appropriateness of limitations on the operation without conducting a full analysis of the property under the scope of an EIR. The proposal to adopt a negative declaration fails to meet the standard. CEQA Guidelines 15063 (g) requires consultation with agencies to determine the appropriateness of an EIR or Negative Declaration. In this case, it appears that the decision to prepare a Negative Declaration was done without the required consultation. 3) A variety of significant impacts are undoubtedly proposed for mitigation. Some of these mitigations rely on the existing County Code. However, the Code is only as good as it's enforcement. A case in point is the DSS quarry to the east of the proposal. A berm was constructed as a visual and sound barrier. However, staff interpretation of the ordinance resulted in the construction of a berm that is as low as 3' above the road level. And the oleanders were planted months after the start of operations with a irrigation system that failed. 4) It is hard to imagine how traffic impacts can be mitigated on one of the deadliest stretches of highway in the region without grade separation of cross-traffic: especially with the fog. 5) Water quality and quantity impacts to surrounding landowners must be addressed.
