The San Joaquin Valley Air Pollution Control District (District) has reviewed the proposed project and offers the following comments: The San Joaquin Valley's air quality has been designated nonattainment by the EPA and by the Air Resources Board (ARB)for 02 (n7one) and PM-10(fine particulate matter, dust). The Federal Clean Air Act (CAA)and the California Clean Air Act require areas that are designated nonattainment to reduce emissions until standards are met. Based upon the information received the District is unable to determine the potential impacts from this operation. However, based upon the size and amount of material to be removed from the site, it seems likely that the project will exceed the Districts levels of significant for both NOx (10 tons/year of Nitrogen Oxides) and VOC (10 tons/yearof Volatile Organic Compounds). If after further review this is the case than an EIR would need to be completed addressing air quality issues. Additionally, the California Air Resources Board (GARB) has identified emissions produced by diesel powered equipment as a toxic air contaminant. GARB has issued a report entitled Risk Reduction Plan to Reduce Particulate Matter Emissions from Diesel-Fueled Engines and Vehicles (October 2000). Appendix VII of the report provides several risk characterization scenarios, which may serve as a starting point for estimating risks from diesel engine emissions. The District will work with applicants to review appropriate methodology for estimating toxic risk. The construction/operational phase of this project can generate emissions from the movement of soil, use of heavy equipment, bulk materials handling, asphalt paving and other related activities. As a result, this project is subject to District Regulation VIII (Fugitive Dust Prohibitions). The purpose of Regulation VIII is to reduce the amount of fine particulate matter(PM-10) entrained into the ambient air from man-made sources. David L.
