Encountering contaminated soil, surface water, and groundwater without taking proper precautions could result in the exposure of construction workers and consequently result in associated significant adverse human health and environmental impacts. (Draft EIR, p. 4.11-12.) Significance Before Mitigation: Potentially Significant. Facts: Previously unidentified contamination may be encountered during project site preparation, construction activities, and mining activities. See Draft EIR,pp. 4.11-12 to 4.11-13. Mitigation Measures Mitigation Measure 4.11.1: If contaminated soil and/or groundwater are encountered or suspected contamination is encountered during site clearing, construction activities, and mining activities, work shall be halted in the area of concern. The Applicant shall determine the type and extent of the contamination by consulting with the appropriate regulatory agencies (RWQCB, DTSC, and/or the San Joaquin or Stanislaus County Health Department) and implementing any necessary measures, such as soil and/or groundwater sampling and analysis. If required by the regulatory agencies, a remediation plan shall be implemented either in conjunction with or prior to continued project construction and/or mining activities. (Draft EIR, p. 4.11-13.) Findings: Based on the whole record, this Commission finds that with implementation of Mitigation Measure 4.11.1, impacts related to encountering existing and/or previously unidentified contamination are reduced to a less than significant level. Impact 4.11.2 During excavation, grading, and construction activities of the proposed facilities, it is anticipated that limited quantities of miscellaneous hazardous substances, such as gasoline, diesel feel, hydraulic fluid, solvents, oils, etc. would be brought onto the site. In addition, the proposed project operations will include the use offuels and other hazardous materials. As with any liquid and solid, during handling and transfer from one container to another, the potential for an accidental release exists. Depending on the relative hazard of the material, if a spill were to occur of signiflcant quantity, the accidental release could pose both a hazard to construction employees as well as the environment.
