Mitigation Measure 6.9: Implement Mitigation Measures 4.9.2a, 4.9.2b, and 4.9.2c to mitigate the project's incremental contribution to biological resource impacts. (Draft EIR,p. 6-15.) Findings: Based on the whole record, this Commission finds that with implementation of Mitigation Measure 6.9.1, the project's contribution to cumulative biological resource impacts are reduced to a less than significant level. FINDINGS REGARDING IMPACTS ANALYZED IN THE EIR AND DETERMINED TO BE SIGNIFICANT AND UNAVOIDABLE This section includes findings for project impacts which are determined to be significant even with the imposition of mitigation measures. These impacts cannot be mitigated to a less than significant level and therefore remain unavoidable. Although this Commission finds that all significant impacts of this project listed below cannot be substantially lessened or avoided by the imposition of mitigation measures or alternatives, the mitigation measures found in the EIR and listed below will be implemented to lessen the project's impact. Specific findings of this Commission for each impact are set forth below in this section. This section, together with Section G of the findings below, addresses the requirements in CEQA Guidelines Section 15093. CEQA requires the lead agency to balance the benefits of a proposed project against its unavoidable significant environmental impacts and to determine whether the impacts are acceptably overridden by the project benefits (outlined in Section F). As described herein,both project-level and cumulative unavoidable significant impacts would occur in the areas of Land Use,Noise and Air Quality. 31
