4.5 Noise L Policy 1. The following exterior noise levels shall be considered acceptable: (a) 65 dBA DNL or less for residential development. (b) 60 dBA DNL or less for schools, group care facilities, and hospitals. Policy 4. Development shall be planned and designed to minimize noise impacts on neighboring noise sensitive areas and to minimize noise interference from outside 1 noise sources. L Policy 6. The county shall seek to alleviate existing community noise problems. U.S. Department of Labor, Mine Safety and Health Administration (MSHA) The mission of the Mine Safety and Health Administration (MSHA) is to administer the ` provisions of the Federal Mine Safety and Health Act of 1977 (Mine Act)and to enforce compliance with mandatory safety and health standards as a means to eliminate fatal accidents; to reduce the frequency and severity of nonfatal accidents;to minimize health hazards; and to promote improved safety and health conditions in the nation's mines. MSHA carries out the mandates of the Mine Act at all mining and mineral processing operations in the United States, regardless of size, number of employees, commodity mined, or method of extraction. V MSHA's current noise standards (1999)require mine operators to monitor workplace noise exposure and provide for miners and their representatives to observe the monitoring. The standards establish several levels requiring mine operators to take action: • Miners exposed to an average sound level of 85 decibels(85 dBA)or more over an 8—hour period must be enrolled in a hearing protection program, which will include special training, hearing tests, and hearing protection. • If workplace noise levels reach 90 dBA or more over an 8—hour period,mine operators must use feasible engineering and administrative controls to reduce noise levels. Hearing protectors are required to be provided and worn if the permissible exposure level cannot be achieved using feasible engineering and administrative .. controls. • At workplace noise levels of 105 dBA or more over an 8—hour period, mine operators must ensure the use of both ear plug and earmuff type hearing protectors. • At no time during the work shift may noise levels exceed 115 dBA. San Joaquin County Development Title Chapter 9, Section 1025.9 of the San Joaquin County Development Title includes maximum L allowable noise exposure levels for transportation and stationary sources,as shown in Table 4.5-1, Parts I and 1I. r.
