r Alternative 4: No Project <br /> a <br /> 1 f <br /> Under this alternative, no disturbance to the project site is proposed and therefore no <br /> impacts to Swainson's hawk are anticipated. <br /> No mitigation is required. <br /> Fi <br /> Impact 4.7-4 <br /> Potential Impacts to Western Burrowing Owl <br /> All uar Excavation Alternatives 1 2 and 3 <br /> Western burrowing owls and their burrows are protected under Section 3503.5 of the <br /> California Fish and Game Code, which prohibits the destruction of raptors and their nests. <br /> This species prefers dry grasslands and other dry, open habitats. Low-quality nesting <br /> habitat occurs on the project site but is restricted to orchard edges and other ruderal areas. <br /> The loss of a burrowing owl or an active nest is a potentially significant impact of <br /> Alternatives 1, 2, and 3. <br /> f <br /> j <br /> Alternative 4: No Proeec <br /> 3 <br /> Under the No Project Alternative, no disturbance of the project site is proposed and <br /> ti therefore no impacts to the western burrowing owl are anticipated. <br /> i <br /> Mitigation Measure 4.7-4a (Alternatives 1, 2, and 3) <br /> Within 64 days prior to the beginning of construction activities, or any project activity j <br /> likely to impact the burrowing owl, the proponent shall retain a qualified biologist to <br /> conduct a pre-construction survey of the affected area. If active nesting sites are <br /> identified, the proponent shall develop and implement remedial programs in <br /> consultation with the CDFG. If no active burrows are found during pre-construction <br /> surveys, a letter report documenting survey methodologand fndingshall be <br /> s l <br /> submitted to the County and CDFG for review and approval, and no further <br /> mitigation will be required. <br /> Level of Significance After Mitigation: <br /> Implementation of Mitigation Measure 4.7-4a would reduce potential impacts to the <br /> � r <br /> western burrowing owl to a less-than-significant level. <br /> Impact 4.7-5: <br /> Cumulative Effects on Biological Resources <br /> 'F Implementation of the proposed mining and reclamation plans would contribute to a <br /> cumulative loss of open/agricultural land, and a concomitant loss of common plant and <br /> animal species.
