CONDITIONS OF APPROVAL MS-92-121 TUBO FARMS, INC. Unless otherwise specified, all Conditions of Approval shall be complied with prior to the approval of the Parcel Map. This approval will expire two (2) years from the date of approval unless, (1) all Conditions of Approval have been complied with, and (2) a Parcel Map has been filed with and accepted by the Surveyor's Division. Those Conditions followed by a Section Number or other Statutory Requirement are based on Ordinance Requirements. Ordinance Requirements cannot be modified. 1. DEPARTMENT OF PUBLIC WORKS: a. A Parcel Map is required. (Planning Title Section 9- 9112) b. Remainder shall be designated as "Designated Remainder" on Parcel Map. (Subdivision Map Act Section 66445) C. The Traffic Impact Mitigation Fee will be required when parcels are developed. The fee is due and payable at the time of building permit application. (The fee currently is $2 , 378. 00 per single family dwelling unit in the Tracy area. The fee shall be automatically adjusted July 1 of each year by the Engineering Construction Cost Index as published by the Engineering News Record. ) (Resolution R-90-304, R-91-1025) d. The frontage improvements for Lammers Road shall be constructed in conformance with the standards for one- half of a 50-foot right-of-way rural street. The construction of the frontage improvements will be deferred, upon execution by the owner of a Deferred Frontage and Roadway Improvement Agreement or a Secured Deferred Frontage and Roadway Improvement Agreement with a deposit equivalent to their estimated construction costs prior to approval of the Parcel Map. (A $250. 00 fee currently is required for processing per Planning Title Section 9-10502 in addition to a copy of the Grant Deed, legal description of Parcel 1 and an estimate. The estimate and legal description shall be prepared by a Registered Civil Engineer with a typical section drawing on a form to be supplied by the Public Works Department
