CONDITIONS OF APPROVAL <br /> MS-92-121 <br /> TUBO FARMS, INC. <br /> Unless otherwise specified, all Conditions of Approval shall be <br /> complied with prior to the approval of the Parcel Map. <br /> This approval will expire two (2) years from the date of approval <br /> unless, (1) all Conditions of Approval have been complied with, and <br /> (2) a Parcel Map has been filed with and accepted by the Surveyor's <br /> Division. <br /> Those Conditions followed by a Section Number or other Statutory <br /> Requirement are based on Ordinance Requirements. Ordinance <br /> Requirements cannot be modified. <br /> 1. DEPARTMENT OF PUBLIC WORKS: <br /> a. A Parcel Map is required. (Planning Title Section 9- <br /> 9112) <br /> b. Remainder shall be designated as "Designated Remainder" <br /> on Parcel Map. (Subdivision Map Act Section 66445) <br /> C. The Traffic Impact Mitigation Fee will be required when <br /> parcels are developed. The fee is due and payable at the <br /> time of building permit application. (The fee currently <br /> is $2 , 378. 00 per single family dwelling unit in the Tracy <br /> area. The fee shall be automatically adjusted July 1 of <br /> each year by the Engineering Construction Cost Index as <br /> published by the Engineering News Record. ) (Resolution <br /> R-90-304, R-91-1025) <br /> d. The frontage improvements for Lammers Road shall be <br /> constructed in conformance with the standards for one- <br /> half of a 50-foot right-of-way rural street. The <br /> construction of the frontage improvements will be <br /> deferred, upon execution by the owner of a Deferred <br /> Frontage and Roadway Improvement Agreement or a Secured <br /> Deferred Frontage and Roadway Improvement Agreement with <br /> a deposit equivalent to their estimated construction <br /> costs prior to approval of the Parcel Map. (A $250. 00 <br /> fee currently is required for processing per Planning <br /> Title Section 9-10502 in addition to a copy of the Grant <br /> Deed, legal description of Parcel 1 and an estimate. The <br /> estimate and legal description shall be prepared by a <br /> Registered Civil Engineer with a typical section drawing <br /> on a form to be supplied by the Public Works Department <br />
