All the lands shown in the summary above are within the adopted sphere of influence <br /> (SOI) for the LID. Not all the lands within the current SOI are being proposed for <br /> annexation at this time however and the acreage total shown in Table 1 is a total of <br /> acreage as indicated by the San Joaquin County Assessor's Office. The total metes and <br /> bounds boundary description of the annexation includes the true total of all acreage <br /> proposed for annexation (which includes open space, water and other features not <br /> necessarily included in the Assessor's calculations). This description is included with <br /> Exhibit"A"; a map showing the proposed annexation area is provided as Exhibit"E". <br /> The LID was established 2002 to provide principally utility services; specifically, sewer, <br /> water, electricity, gas and telecommunication services. LID was first envisioned as a <br /> public service provider for the River Islands at Lathrop mixed used development <br /> approved by the City of Lathrop in 2003. Consistent with the River Islands project <br /> approvals and Development Agreement with the City of Lathrop, LID is an integral part <br /> of the infrastructure program for the River Islands development. LID is part of a joint <br /> powers authority (with Island Reclamation District No. 2062, known as the River Islands <br /> Public Financing Authority or "RIPFA" for short). LID, through RIPFA has already <br /> issued over $29 million dollars in public debt for the design and construction of major <br /> water and wastewater facilities for the River Islands project. RIPFA will continue to be <br /> an important financing vehicle for additional River Islands and LID infrastructure. <br /> A. Background <br /> Lathrop Irrigation District("LID") was formed in November 2002 by a unanimous <br /> registered voter election and approved by the San Joaquin County Local Agency <br /> Formation Commission("LAFCO"). This initial formation of LID included over 236 <br /> acres of land on the Stewart Tract, an area approved for development by the City of <br /> Lathrop within the River Islands project described above. At the time of formation, <br /> LAFCO approved 5,668.5 acres on the Stewart Tract be included in LID's SOI. This <br /> additional acreage encompasses areas outside the River Islands development area. The <br /> area proposed for annexation does not include the entire SOI area(Exhibit"B"). Exhibit <br /> "B"also shows the current LID boundaries. <br /> At the time of formation, LID stated in its 2002 Plan for Services that it fully intended to <br /> annex land to its boundaries consistent with its SOI. LID first made such a request to <br /> LAFCO in December 2003. However, due to comments submitted by Pacific Gas and <br /> Electric("PG&E") regarding the adequacy of the proposal and initial study, LID <br /> withdrew its initial request in order to provide more detail as to its proposal and to <br /> request environmental review by San Joaquin County, which under Public Utilities Code <br /> Section 9607 (e),must be the lead agency under CEQA for such a request. <br /> LID, at the request of 100%of the affected landowners within the annexation area, have <br /> petitioned LAFCO to annex all additional lands within LID's SOI for the primary <br /> purpose of providing water, sewer,recycled water,telecommunication and electrical <br /> services. <br /> 3 <br />
