Lease Agreement <br /> This agreement is made and entered into this 20th day of August 2012,between Melvin M. & <br /> Judith A.Abrew,as Lessor,and Rogers Media Company of Davis,California,as Lessee.The <br /> parties hereby agree as follows. <br /> Melvin M. &Judith A.Abrew, hereinafter called Lessor,represent that they own the property <br /> known as APN number,218-020-03,with a physical address of 5936 East Lathrop Road in <br /> Manteca, California.Lessor agrees to lease to Lessee, all general advertising signage rights to <br /> said property.More specifically,Lessor grants to Lessee the use of said property for the purpose <br /> of installing and maintaining a free standing advertising structure,to be used for general <br /> advertising purposes,for a period of Twenty(20)years,with an option to renew for like period. <br /> The option must be exercised by written notice at least ninety(90)days prior to the expiration of <br /> this lease. If during the tern of said lease agreement Lessor desires to cancel due to construction <br /> on the property where the sign is located,Lessor must provide to Lessee evidence of such <br /> building permits along with a One-hundred and eighty(180)day notice to vacate said premises. <br /> Such notice must be sent return receipt requested to the office of Lessee on file noted below or <br /> subsequently changed thereafter during the term of the Agreement. <br /> Said finished structures will be a 12 x 40"double-faced sign,one pole sign structure,measuring <br /> no more than sixty-five to the highest point. This lease includes the ground and air space <br /> necessary to build,maintain, service and install said structure and subsequent advertising <br /> messages. <br /> Rent will commence upon the placement of said sign structure and continue monthly thereafter. <br /> In consideration thereof,Lessee agrees to pay Lessor$14FANOWper year, payable on a <br /> monthly basis at$350W per month. If rent is not paid within 15 days of the due date(every <br /> fust of the month for the month preceding),a late of 5%of the payment shall be imposed.On <br /> every third anniversary from said structure's erection date and therefore the start of said lease <br /> rent shall increase by five(5%)percent from the baseline rent and continue as such throughout <br /> said agreement. If during the term of this Agreement Lessee is allowed by governmental <br /> authorities to erect a"tri-vision"display on said structure rent shall increase to$limper <br /> year, payable on a monthly basis of $NN OIIiRper month. <br /> Lessor shall allow Lessee to install lighting fixtures for purposes of night lighting of the <br /> advertisement.All electrical installations and fixtures shall be in compliance with applicable <br /> building codes. Lessee shall at all times incur all electrical expenses relative to said signs. <br /> Lessee shall at all times retain ownership of all structures,permits, and electrical fixtures placed <br /> upon Lessor's property and may remove same upon termination of this lease,regardless of the <br /> fact that said structures may constitute real estate fixtures. If Lessor fails to obtain proper permits <br /> for the erection of said signs, such lease shall be come null and void. <br /> Lessee shall hold Lessor harmless from any loss, damage, or injury in the installation, <br /> maintenance or removal of said signs on the above mentioned properties.
