CONDITIONS OF APPROVAL <br /> PA-0800171 <br /> Enos <br /> Minor Subdivision Application No. PA-0800171 was approved by the San Joaquin County <br /> Community Development Department on August 1, 2008. The effective date of approval is August <br /> 11, 2008. This tentative map approval will expire on August 11, 2011, which is three years from the <br /> effective date of approval, unless (1) all Conditions of Approval have been complied with and (2) a <br /> Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Jason Jones, 209-468-3136) <br /> a. TENTATIVE MAP: The Parcel Map shall substantially conform with the approved tentative map <br /> dated May 23, 2008. <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note <br /> shall be placed on the Parcel Map and recorded as a separate instrument: <br /> (1) All persons purchasing lots within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities, <br /> such as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniencies or discomforts shall not be considered to be a nuisance. <br /> c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) Parcels 1 and 3 shall have a minimum lot width of 330 feet, measured at the front yard setback <br /> line. (Development Title Section 9-610.4) <br /> (2) Parcels 1 and 3 shall have a minimum lot area of 35 acres. (Development Title Section 9-610.2) <br /> (3) Parcels 2 and 4 shall have a minimum lot width of 150 feet. (Development Title Section 9-610.4) <br /> (4) Parcels 2 and 4 shall be between two (2) net acres and five (5) gross acres in size. <br /> (Development Title Section 9-610.3[a]) <br /> d. TRANSFER RESTRICTION FOR PARCEL 2: A Note shall be placed on the Parcel Map and a <br /> Notice of Minor Subdivision Restriction shall be recorded for Parcel 2 concurrently with the Parcel <br /> Map, with a reference to the instrument number of said recorded notice, stating that: <br /> (1) The homesite shall not be transferred until August 11, 2018, or upon the death of an <br /> owner owning at least fifty (50) percent interest in the homesite parcel, unless the <br /> homesite parcel and the remainder parcel are merged pursuant to the provisions of the <br /> Development Title. <br /> (2) The property shown on the Parcel Map is restricted from further subdivisions for <br /> homesite purposes, except for financing only, by Section 9-610.3 of the San Joaquin <br /> County Development Title. <br /> Conditions of Approval 1 - PA-0800171 <br />
