CONDITIONS OF APPROVAL <br /> LA-00-14 <br /> Shively <br /> r <br /> Lot Line Adjustment Application No.LA-00-14 was approved by the San Joaquin County Community <br /> Development Department on March 22, 2000,which is the effective date of approval. <br /> Unless otherwise specified,all Ordinance requirements shall be complied with prior to approval of a <br /> Notice of Lot Line Adjustment. <br /> This approval will expire on September 21, 2001, which is 18 months from the effective date of <br /> approval, unless a Notice of Lot Line Adjustment has been filed with and accepted by the County <br /> Surveyor. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Tina Wehrmeister, 468-8477) <br /> a. NOTICE OF LOT LINE ADJUSTMENT: A"Notice of Lot Line Adjustment"shall be recorded prior to <br /> conveyance of property through deeds by the owner. Legal descriptions of the lands to be <br /> exchanged shall be submitted to the Surveyors Division for review and forwarding to the Community <br /> Development-Department. The legal descriptions shall be prepared,stamped,and signed by a <br /> Registered Civil Engineer,qualified to practice Land Surveying per Section 8731 of the Land <br /> Surveyors'Act, or a Licensed Land Surveyor. <br /> b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) Parcel 3 shall have a minimum lot width of 150 feet. (Development Title Section 9-610.4) <br /> (2) Parcel 3 shall have a minimum lot area of 2 acres and a maximum lot area of 2.15 acres. <br /> (WilliamsonAct, California Government Code) <br /> c. WILLIAMSON ACT CONTRACT: An application for a California Land Conservation Contract(also <br /> known as the Williamson Act)shall be filed prior to recording the Notice of Lot Line Adjustment. <br /> Legal descriptions reflecting the new parcel configurations shall be submitted with the application: <br /> Filing fees are required for this application. <br /> d. NOTICE OF NON-RENEWAL: A Notice of Non-renewal for all parcels below the ten (10) acre <br /> minimum parcel size will also be initiated by San Joaquin County in conjunction with the contract. A <br /> fee for the recording of the Notice of Non-renewal is required. <br /> e. ACCESS: An minimum 25-foot-wide easement for access to Parcel 4 shall be recorded with the <br /> Notice of Lot Line Adjustment and on the new deeds. <br /> f. IMPROVEMENT PLAN: Prior to development of non-agricultural structures on Parcel 4, an <br /> Improvement Plan application for a private right-of-way shall be filed with and approved by the <br /> Community Development Department (Development Title Section 9-872.2[c]). A fee is required <br /> to process the Improvement Plan. This condition shall be recorded on the Notice of Lot Line <br /> Adjustment. <br /> 2. DEPARTMENT OF PUBLIC WORKS (Staff Contact: Richard Hieb,468-3000) <br /> a. A Recorded Deed is allowed, but if points or lines are set, a Record of Survey is required. The new <br /> legal descriptions shall be submitted to the Surveyor's Office for review. (Development Title Section <br /> 9-872.4) <br /> b. The new legal descriptions must reflect correct distances with qualifiers to avoid overlaps or gaps. <br />
