CONDITIONS OF APPROVAL <br /> MS-92-167 <br /> STANLEY AND BETTY ROBERTSON FAMILY TRUST <br /> Unless otherwise specified, all Conditions of Approval shall be <br /> complied with prior to the approval of the Parcel Map. <br /> This approval will expire two (2) years from the date of approval <br /> unless, (1) all Conditions of Approval have been complied with, and <br /> (2) a Parcel Map has been filed with and accepted by the Surveyor' s <br /> Division. <br /> Those Conditions followed by a Section Number or other Statutory <br /> Requirement are based on Ordinance Requirements. Ordinance <br /> Requirements cannot be modified. <br /> 1. DEPARTMENT OF PUBLIC WORKS: <br /> a. A Parcel Map is required. (Planning Title Section 9- <br /> 9112) <br /> b. Remainder shall be designated as "Designated Remainder" <br /> on Parcel Map. (Subdivision Map Act Section 66445) <br /> C. The Traffic Impact Mitigation Fee will be required when <br /> parcels are developed. The fee is due and payable at the <br /> time of building permit application. (The fee currently <br /> is $2 , 378 . 00 per single family dwelling unit in the Tracy <br /> area. The fee shall be automatically adjusted July 1 of <br /> each year by the Engineering Construction Cost Index as <br /> published by the Engineering News Record. ) (Resolution <br /> R-90-304, R-91-1025) <br /> d. Dedication to result in a 42-foot wide right-of-way from <br /> the centerline of Linne Road to the property line shall <br /> be required across the frontage of Parcels 1, 2 , and 3 . <br /> (Planning Title Section 9-9430, 9-9431) <br /> e. The frontage improvements for Linne Road across Parcels <br /> 1, 2 , and 3 shall be constructed in conformance with the <br /> standards for one-half of an 84-foot right-of-way rural <br /> arterial road. The construction of the frontage <br /> improvements will be deferred, upon execution by the <br /> owner of a Deferred Frontage and Roadway Improvement <br /> Agreement or a Secured Deferred Frontage and Roadway <br /> Improvement Agreement with a deposit equivalent to their <br /> estimated construction costs prior to approval of the <br /> Parcel Map. (A $250. 00 fee currently is required for <br /> processing per Planning Title Section 9-10502 in addition <br />
