The wood shaving operation has been
vacant from this site for quite some time, well over the advised 12 months per Mr.
Herzick and Ferrano.
On or about 10/28/02 you stated to me there was an exception in the code which allowed
the use permit to remain valid as long as the subject property was for sale. I did not
observe any for sale signs on this property until well after the 12 months from the time
the wood shaving operation had vacated. Do you have written proof the subject property
was for sale?
The fact that the property had lost its use permit to operate a business and returning back
to the residential zoning has impacted my family's decision not to sell our home. As you
can see the information provided by Mr. Herzick and Ferran that the property would lose
its use permit if no like business occupied the property within 12 months highly impacted
our financial and qualify of life decision to remain and not to sell.
There is a row of houses that encompass Locke road on the same side of the street
concurrently starting from Hwy. 88 and traveling West to Treathway Road. The only
other property that is not residential is the Locke property adjacent to the subject property.
The Locke property is a walnut hulling operation that only operates seasonally. The
remainder of the properties is residential on this side of the street with agriculture
surrounding.
I will list our concerns in detail regarding a business operation located on the subject
property:
Points of Concern
Traffic from the business employees and delivery vehicles. This traffic causes additional
noise and an eyesore.
Noise from the forklifts occurs during the day and night.
The operation of a carpet warehouse and employees dispatching is inconsistent with
country living and a residential setting.
Lighting from the lights at the current structure are consistent with a business operation
and are a nuisance to the remaining residential property owners.
The obvious increased traffic from the delivery and employee vehicles will cause dust and
particulate matter when vehicles are moved about the property.
The fact that there is an estimate of 5-20 employees working next door leaves me a little
uncomfortable when I leave my family alone. The reason I moved to the country is to get
my family out and away from the city life and not next to a functional business with
varied traffic patterns.
