(Seasonal) <br /> Describe any on-site or off-site sources of light or glare(e.g.parking lot lighting or reflective materials used): <br /> There is no proposed on-site or offsite sources of light or glare. <br /> Describe any on-site or off-site odor(e.g.agricultural wastes): <br /> ere is very little odor from fertilizers and Government approved pesticides for Ag use. <br /> Describe any displacement of people that will be caused by the project(e.g.numbers of people,housing units): <br /> There will be no displacement of people as a result of this project. <br /> FINDINGS <br /> The following findings of fact must be made by the County before a Variance can be granted. Indicate what facts in the case of this application <br /> support each of the findings. These findings that you provide will be included with the Staff Reports that are distributed to members at the <br /> Planning Commission. <br /> 1.)Because of the special circumstances applicable to the property, including size, shape, topography, location or surroundings, the stric <br /> application of the zoning regulations deprives the property of privileges enjoyed by other properties in the vicinity and under identical zonin <br /> classification. <br /> This project proposes NO new development. The rice dryer business was established in its current location <br /> ajjpproximately 25 years ago. The special circumstances that make this project so unique is the fact that <br /> the existing Dryer is the only operating Rice Dryer in the area.Its operation is a necessary a related business <br /> that plays a significant part in the distribution of the rice crop own in San Joaquin County. While the Rice <br /> Dryer operation is obviously agricultural in nature,its aggregate operations differ from that of the remainder <br /> farm use. The prop"owner is facing financial hardship, due to the combined uses of the roe and her <br /> inability to personally farm the land,thus the proposed 10.34 acres is not being utilized to its greatest <br /> otential. The proposed project would permit the owner to punue other options for the proposed 10.34 acres <br /> of farm land while not deprhing her of the ability to continue current Rice Dryer operation. <br /> 2.)The granting of the Variance will not constitute a grant of special privileges inconsistent with the limitations upon other properties in th <br /> vicinity and zone in which the property is situated. <br /> The AL General zone makes allowance for 5 to 10 parcel sizes. The proposed size of 5 acres, encompasses the <br /> entire Rice Dryer operations at the existing levee. The general curb side appearance of the subject site will <br /> have a less than signifccarnt impact to surrounding properties. The existing land use and physical <br /> characteristics will not exceed the special privileges enjoyed by other properties in the vicinity, specifically call the <br /> convenience supply store,veterinary clinic, auction yard,welding shop, etc. It should be considered that the <br /> Rice Dryer operation will continue to serve the community. There will be no change in existing land uses and <br /> and the proposed project WILL NOT have a ne etive impact on surrounding properties. <br /> Page 5 of 8 <br />
