Development Title Section 9-1015.5[e] requires that all parking spaces, <br /> driveways, and maneuvering areas must be surfaced and permanently maintained with base <br /> material of appropriate depth and asphalt concrete or Portland cement concrete to provide a <br /> durable, dust free surface. Bumper guards must be provided when necessary to protect adjacent <br /> structures or properties. The applicant will be required to meet this requirement as a condition of <br /> approval for this project. <br /> Screeninu <br /> The submitted site plan shows a proposed trash enclosure. Development Title Section 1022.4[d] <br /> [2]) states that all storage materials and related activities, including storage areas for trash, shall be <br /> screened so as not to be visible from adjacent properties and public rights-of-way. Screening must <br /> be six (6) to seven (7)feet in height. Outside storage is not permitted in front yards, street side <br /> yards, or in front of main buildings. The applicant will be required to meet this requirement as a <br /> condition of approval for this project <br /> Opposition <br /> The Community Development Department received two letters of opposition and a copy of a letter <br /> of opposition addressed to each Planning Commissioner. The letters expressed the following <br /> concerns: <br /> ■ Noise generated by the birds. - <br /> • Potential contamination to local drinking water. <br /> ■ Odor from bird waste. - <br /> ■ Spread of disease carried by birds. <br /> E <br /> The project is an agricultural operation; agricultural uses are not subject to the noise ordinance. In <br /> addition, the project is not a noise sensitive land use. Therefore, the project will not be subject to <br /> the noise ordinance contained in Development Title Section 9-1025.9. A referral has been sent to <br /> the Environmental Health Department to address any contamination issues to the local water table <br /> and to address any potential spread of disease as a result of the bird waste. A referral was also <br /> sent to the San Joaquin Air Pollution Control District concerning potential air pollution or impact to <br /> air quality; a response has not yet been received. <br /> Use Permit Application No. PA-0800145 is tentatively scheduled to be heard before the <br /> Planning Commission on June 19, 2008. The Community Development Department has <br /> reviewed the project and responses from other agencies, and assuming any outstanding issues <br /> have been resolved, will be recommending that the Planning Commission approve the project <br /> subject to the following conditions: <br /> Use Permit Application No. PA-0800145 was approved by the Planning Commission on . <br /> The effective date of approval is . This approval will expire on ,which is 18 months from the G <br /> effective date of approval, unless (1) all Conditions of Approval have been complied with, <br /> (2) all necessary building permits have been issued and remain in force, and (3) all <br /> necessary permits from other agencies have been issued and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be <br /> fulfilled prior to the establishment of the use and the issuance of any building permits. <br /> Those Conditions followed by a Section Number have been identified as ordinance <br /> 2 <br />
