Analysis <br /> Background <br /> On April 19, 2001, the Planning Commission approved Use Permit No. UP-93-14 with an expiration date of <br /> October 29, 2002. On September 19, 2002, the applicant applied for a one year Time Extension to extend the <br /> expiration date to October 29, 2003. No additional Time Extensions can be requested. <br /> The Community Development Department received one letter in opposition that raised issues of noise and <br /> flooding. <br /> Noise <br /> The letter is from a property owner directly across the river from the project site. That neighbor expressed her <br /> concern that construction around the water ski lake might include loudspeakers for broadcast of amplified music. <br /> Approved Conditions of Approval 1.1. and 1.m. state: <br /> 1.1. No water boating activities shall take place after 7:00 p.m. <br /> M. Nojet skis will be allowed on the lake. <br /> The issue of amplified music is not specifically addressed by the Conditions of Approval. However, the project is <br /> subject to the noise regulations of the Development Title. The project description does not include amplified <br /> music. Any change to the Conditions of Approval would require a Revisions of Approved Actions application. <br /> Flooding <br /> The neighbor who wrote the letter indicated that her property lies within Reclamation District 2075 and asked that <br /> the Community Development Department send a project referral to that district. A Department mailed a project <br /> referral to that district on October 31,2002. <br /> The San Joaquin River borders this site on the north, east, and south. A 100-year levee of ReclamFton District <br /> No. 2095 borders this site on the west. The Department of Public Works determined that this site is within a <br /> Federal Flood Insurance Administration Designated Flood Hazard Area. The 100-year Flood Elevation will be <br /> approximately 28.2 feet NGVD. All structures shall meet the floodplain management standards. The <br /> Department of Public Works Flood Control Division will review the improvement plans. In addition, a permit is <br /> required from the State Reclamation Board. <br /> Findings <br /> Since the project approval, there have been no physical changes in circumstance that would change the ability to <br /> make the required Use Permit findings. <br /> San Joaquin County UP-93-141Eagal <br /> Community Development Page 3 <br />
