RESOLUTION OF PARADISE NNMON RECLAMATION DISTRICT , <br /> No.2095 <br /> GRANMG THE REQUEST OF JOHN EAGAL TO APPLY FOR <br /> AN ENCROA(-ANT I`ERMfT IN AND ALONG THE DISTRICT'S LEVEE <br /> WHEREAS, John Eagal is a landowner within the geographical boundaries of Paradise f <br /> Junction Reclamation District; and, E <br /> WHEREAS, the property owned by John Eagal, (APN: 2.39-140-03, 06; 12 West � <br /> Lorenzen Road,in the unincoporated area east of Tracy)has an access point at the i <br /> northeast end ofLorenzen Road near the District designated station 120+00 which is <br /> Lvmently a dirt roadway over the District's levet; and, <br /> WHEREAS,John E,agai has made application to the County of San Joaquin Community <br /> Development Aepartment for a Use Permit for purposes of developing then property <br /> hereinbefore descnbed into a private water gd club(Usc Permit Application No. UP-93- <br /> 14); 24 <br /> WHEREAS, the aforementioned application has been conditionally approved by the <br /> County of San Joaquin Community Development Department; and, <br /> WHEREAS,it is understood that the intent and design of this project must undergo the <br /> scrutiny of the State Reclamation Board and the Army Corps. of Engineers and it is j <br /> fixrther understood that the District dors not in anyway watra,nil,guarantee, adopt, <br /> support, condone, acquiesce,reject, disapprove, condemn or otherwise present any C <br /> position regarding the soundness and/or feasibility of the project or its design, in short, <br /> the District maintains a neutral position as to the project; and, <br /> WHEREAS,it is necessary for John Eagal to acquire the approval of the District prior to <br /> presenting his application for an encroachment permit to the State Reclamation Board for <br /> purposes ofusing the aforementioned access point for access in conjunction with the <br /> proposed private ski club; and, <br /> WHEREAS, the District'is charged with the responsibility of operating and maintaining -. <br /> the levee as a flood control structure and the proposed project of John Eagal does present <br /> some impacts to the District's responsibilities;and, <br /> WHEREAS, at a meeting of the Board ofDirectors held October 11, 200I,it was agreed, <br /> as part of the Board's authority,to submit a resolution indicating approval of John j <br /> Eagal's intent to use the aforementioned access point in conjunction with the proposed <br /> private ski club in support of the intended application ofJohn Eagal to the State <br /> Reclamation Board for an encroachment permit conditioned upon enumerated items. <br /> NOW, THEREFORE, IT IS RESOLVED that the Paradise Junction Reclamation District <br /> No. 2095 approves,by and through its Board of Trustees, the request of John Eagal, <br /> Owner of property designated APN:2390-140-03 and 239-140-06 which is the subject of <br /> I ; <br />
