u <br /> CONDITIONS OF APPROVAL <br /> PA-0900030 <br /> Val San Associates <br /> Entertainment Permit Application No. PA-0900030 was approved by the San Joaquin County <br /> Community Development Department on March 23, 2009. The effective date of approval is April 2, <br /> 2009. This approval will expire on October 2, 2010, which is 18 months from the effective date of <br /> approval, unless (1) all Conditions of Approval have been complied with, (2) all necessary building <br /> permits have been secured and remain in force, and (3) all necessary permits from other agencies <br /> have been secured and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as Ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other Ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT(Staff Contact: John Funderburg, 468-3160) <br /> a. APPROVED.USE: This approval is for an Entertainment Permit to allow for live entertainment <br /> and dancing inside an existing bar on the site plan dated February 9, 2009. <br /> b. HOURS OF OPERATION: All entertainment establishments shall be closed and all patrons shall <br /> vacate the premises between 2:00 a.m. and 6:00 a.m., except that as part of a New Year <br /> celebration, entertainment establishments may remain open until 3:00 a.m. on January 1st. <br /> (Development Title Section 9-1085.8 [a]) <br /> c. HOURS OF,QPERATION (RESPONSIBLE PERSON): A Responsible Person must be present <br /> in the entertainment establishment during all hours that the entertainment establishment is open <br /> and offering entertainment. (Development Title Section 9-1085.8 [c]) <br /> i <br /> d. NOISE ABATEMENT: <br /> (1) Indoor Establishments: No loudspeakers or sound equipment shall be used for the <br /> amplification of sound to a level audible beyond the walls of the building in which the <br /> busines§ is located. (Development Title Section 9-1085.12 [a]) <br /> e. ORDERLY DISPERSAL REQUIRED: Each Responsible Person shall use reasonable efforts to <br /> cause the orderly dispersal of patrons from the vicinity of the establishment at closing time. <br /> (Development Title Section 9-1085.14) <br /> f. ALCOHOLIC BEVERAGE ON PREMISES: <br /> (1) It is unlawful for any person to bring an alcoholic beverage onto the premises unless such <br /> action is allowed by the entertainment establishment's ABC license. <br /> (2) It is unlawful for any Responsible Person to allow any person to bring an alcoholic beverage <br /> onto the,premises unless such action is allowed by the entertainment establishment's ABC <br /> license.
